How Carlo Bollino took Naureda Llagami's property and the judge received

The damage caused to the state is not only the public property donated to Carlo Bollinos. In the following, we will show you how, by playing with the decisions of the Property Treatment Agency and interventions in the Court, another bill of 2.9 million euros was taken from the pockets of Albanian taxpayers to compensate the former owners. And this time the scandal also involves characters from the justice system, since the beneficiaries are Naureda Llagami, the former president of the Supreme Court of Justice, on behalf of her predecessors. The court and the ATP, instead of proceeding according to the law for the return of the property, which as it turns out was free, have decided that the former owners be compensated with no less, but 2.9 million euros, for the property that with the blessing of the government of Edi Rama was donated to Carlo Bollinos.

The Plug show continued its investigation into the ownership of the land on which Carlo Bollino built Report TV. The scandal deepens even further, and now involves not only the government, but also the new justice system. The suspicious scheme is revealed by a court decision, published exclusively by the Plug show. Part of the property acquired by Carlo Bollino is owned by the late citizen, Sabrie Llagami, grandmother of the former president of the High Judicial Council, Naureda Llagami.

The heirs of Sabrie Llagami have addressed the Property Restitution and Compensation Commission of the Municipality of Tirana with request no. 1461. By decision of the Property Restitution and Compensation Commission of the Municipality of Tirana no. 667, dated 16.06.1996, it has been decided:

“To recognize Sabrije Llagami, her heirs, as former owners of the property consisting of a plot of land with an area of ??9,500 m² with these boundaries… To compensate the legal heirs of the former owner Sabrije Llagami for the plot of land occupied by permanent and state constructions (palaces, roads, houses and commercial car park) with an area of ??9,500 m² in one of the ways specified in Article 6 of Law No. 7698, dated 15.04.1993…”.

With decision no. 668, dated 16.08.1996 of the Property Restitution and Compensation Commission, the property was recognized, also defining fixed boundaries as to the area and location of this property:

“1. To recognize Sabrije Llagami as the former owner of a property consisting of a plot of land with an area of ??5,650 m² located in the Shëngjin district, in the New Neighborhood of Tirana, which is bordered: East by the land occupied by Dylbere Vaqarri, West by the land of Ismail Haxhi Pëllumbi, North by Kroi Shëngjin Street and South by the land of the Begeja brothers. The property is returned and compensated as follows:

The vacant plot of land with an area of ??1,740 m² (as defined in the Gent-plan, including unauthorized constructions) and based on Article 19 of Law No. 7698, dated 15.04.1993, ownership of this plot is recognized and returned to the owner Sabrije Llagami.

The land occupied by permanent constructions (buildings and sports fields of the Partizani Sports Club with an area of ??3,910 m²) and based on Article 16 of Law No. 7698, dated 15.04.1993, the owner Sabrije Llagami (her heirs) shall be compensated for the area of ??the aforementioned land in one of the ways provided for in this article. Based on Article 21 of Law No. 7698, dated 15.04.1993, recognizes the owners Sabrije Llagami (her heirs) the right of pre-emption of the sports facilities of the Partizani Club, consisting of a part of the gym with a surface area of ??140 m², of the 4 KT building with a surface area of ??200 m², of the 2 KT building with a surface area of ??250 m², a part of the gang with a surface area of ??360 m² and the sports grounds of the Partizani sports club with a surface area of ??2,960 m² when they are privatized.

2. The commission has recognized the ownership of a plot of land of 8,470 m² to the Saliaga family with decision no. 7, dated 15.04.1995".

From the definitions of the property boundaries and the details of the buildings included by the Partizani Club, as well as the border guards, the Begeja brothers and the Saliaga family, it is clearly understood that the land is exactly where Carlo Bollino has set up the television, which opens and closes by cursing and insulting the opposition.

And it was even the media that organized a campaign of accusations and slander, demanding an account from Jamarbër Malltez because he took the property inherited from his grandparents in that very area. By Carlo Bollino's standard, he should have been the beneficiary and not the heirs of the indigenous families.

The heirs of the former owner Sabrije Llagami have previously addressed the ATP, asking it to conduct a financial evaluation of their property disposed of by decision no. 667, dated 16.08.1996 of the KKKP. With letter no. 10160/1 prot., dated 27.11.2020, the ATP responded to the applicants that the cadastral entry in which this property was part at the time of expropriation is not identified with evidence and that in 1941 this property was agricultural land.

As above, the plaintiff and the main interveners as heirs of the former owner Sabrije Llagami, on 27.07.2020, addressed the First Instance Administrative Court of Tirana with the lawsuit. So far it can be seen that the heirs of Sabrie Llagami have addressed the Property Treatment Agency to make the evaluation and financial compensation and until 2020 they have not benefited.

One of Sabrie Llagami's heirs is her son, Adnan Llagami, the father of Naureda Llagami, who served as the President of the High Judicial Council from December 2018 to 2024. This position of one of the heirs would be sufficient to intervene in the judicial system, so that at the height of the file blockage, the Court would make a decision in record time.

As stated in the decision, the heirs had previously approached ATP, but surprisingly the latter responded in November 2020. This time is related to the construction of Report TV.

Gjykata Administrative e Shkallës së Parë Tiranë, me vendimin nr. 2179, datë 06.07.2021, ka vendosur:

Pranimin e kërkesëpadisë së paditësve Adnan Llagami, Argjend Tafaj, Lindita Tafaj, Kamela Tafaj, Megi Tafaj, Adela Vasili, Mirnije Llagami, Artan Verzivolli, Arta Shehu.

Pranimin e kërkesëpadisë së ndërhyrësve kryesorë Rudina Llagami, Artur Llagami, Ervin Llagami, Ardian Llagami.

Vlerësimin financiar të vendimit nr. 667, datë 16.08.1996, të ish-Agjencisë së Kthimit dhe Kompensimit të Pronave pranë Bashkisë Tiranë në vlerën monetare 292,438,500 lekë (rreth 2.9 milion euro).

Pra, Gjykata Administrative e Shkallës së Parë ka vendosur të kompensojë trashëgimtarët dhe detyron shtetin të paguajë 292 milion lekë.

Pjesë e rëndësishme e këtij procesi është argumentimi që ATP ka dhënë para gjykatës përse nuk e ka kryer më parë kompensimin, pasi vlerat financiare do të kishin një faturë më të ulët për Buxhetin e Shtetit.

“ATP, edhe pse ka patur kërkesë për këtë vlerësim financiar dhe procedurë verifikimi, nuk ka kryer vlerësimin financiar të vendimit nr. 667/1996.”

Në lidhje me këtë moment, ende pa u përcjellë çështja në gjykatë, ATP iu ka kthyer trashëgimtarëve të Sabrije Llagami se ky vlerësim nuk mund të kryhet pasi nuk arrihet të identifikohet zëri kadastral i pronës në kohën e shpronësimit.

Gjatë gjykimit, pala e paditur përsëriti një tjetër argument: shkaku pse ATP nuk kishte bërë vlerësimin financiar është fakti se trashëgimtarët e Sabrije Llagami nuk kanë hequr dorë nga e drejta e parablerjes, cituar në vendimin nr. 667/1996. Pra, është e qartë se trashëgimtarët kanë kërkuar vlerësimin financiar dhe ATP nuk e ka kryer brenda afatit 3-vjeçar.

Kjo tregon se prona dhe godina që iu dha Carlo Bollinos, në fakt duhej t’u kthehej ish-pronarëve, duke shmangur një dëm financiar prej 2.9 milion euro për shtetin dhe taksapaguesit shqiptarë.

Me procedurën e nisur nga ATP për kthim dhe kompensim prone dhe procesin gjyqësor, procedura e Anila Denajt dhe qeverisë së Edi Ramës për t’ia dhënë pronën Belind Ballukut është bazuar mbi falsifikim dokumentesh dhe shkelje të ligjit.

Më 20.06.2019, me shkresën nr. 10919/1 prot., Ministria e Financave dhe Ekonomisë i drejtohet Ndërmarrjes Industriale Nr. 1 me lëndë:

“Dërgohet për shqyrtim kërkesa nr. 134 datë 06.06.2019… Sa më sipër, Ndërmarrja Industriale Nr. 1, si njësia që ka në varësi administrative pronën shtetërore, përgatit dokumentacionin:

dh) Konfirmimin nga Zyra e Regjistrimit të Pasurive të Paluajtshme për pronësinë shtetërore të objektit dhe truallit, si dhe nga Agjencia e Kthimit dhe Kompensimit të Pronave për vendimet që mund të ketë dhënë për njohje ose kthim prone.

Gjithashtu, kërkojmë të konfirmoni nëse ka kërkesa nga ish-pronarët e truallit, me vendime të ndryshme të komisioneve të kthimit dhe kompensimit të pronave, që konsistojnë në njohjen, kthimin apo të drejtën e parablerjes mbi pasurinë e sipërcituar.

Nëse mbi pasurinë e sipërcituar ka filluar ndonjë procedurë privatizimi ose mund të jetë dhënë me privatizim.”

So, Minister Denaj was clear that the leasing procedure with Carlo Bollino could not continue if there was a decision on that property for return, compensation, and the right of pre-emption.

In the practice sent to Deputy Flamur Noka for this procedure, only the ATP's response with letter no. 6396/1, dated 11.06.2019, was missing. All of this will be verified by SPAK, which has not acted on the Democratic Party's complaint for over two years. It is up to Prosecutor Sotir Kllapi to investigate whether this property is part of the rental contract for Carlo Bollino, which would expose a serious legal violation.

So far it is clear: the heirs have addressed the Administrative Court of First Instance in July 2020 and July 2021. Against decision no. 2179, dated 06.07.2021, the defendant, the Property Treatment Agency, has filed an appeal. Against this decision, the State Attorney's Office has requested the amendment of the decision and the dismissal of the lawsuit.

The Administrative Court of Appeal, with decision no. 82, dated 01.02.2023, has decided:

“Enforcement of decision no. 2179, dated 06.07.2021 of the Administrative Court of First Instance of Tirana.”

So, within 18 months, the Administrative Court of Appeal decided to compensate the family of Naureda Llagami with 2.9 million euros. This is a scandal, about which MP Këlliçi asked the current head of the KLGJ in the parliamentary committee, and there is still no answer.

Of course, there is no action from the High Inspector of Justice in this case either, as Albanians wait an average of 5–7 years for a decision in the Courts of Appeal. While it took Naureda Llagami's family only 4 years to be awarded 2.9 million euros.

Moreover, this case represents a double damage to Albanian citizens: on the one hand, Italian businessman Carlo Bollino, who does government propaganda, took the building and millions to build the television; on the other hand, the president of the Supreme Court of Albania, Naureda Llagami, benefits from 2.9 million euros for the property that Edi Rama gave to Bollino, instead of returning it to the former owners. /Syri.net
