A citizen from Kavaja appeared on the show "Stop" on TV Klan after revealing that she separated from her ex-husband, with whom she has two children, aged four and nine. She says that they separated because her ex-husband did not allow her to practice Islam and left home with the children.

A month later, he takes the children to meet them and never returns them. The woman filed for divorce in Durrës and her ex-husband filed for it in Tirana, where the citizen filed a request for a temporary measure, but the judge did not approve it.

Both parties are also granted a protection order, but no psychological report is made and the court decides that the mother will only see the children on Fridays. The woman asks to spend more time with them, as she has been seeing them very little for a long time.

"Hello, I am a citizen of Kavaja. I have been married for 12 years to a citizen from Kavaja, from this marriage I have two children aged nine and four. Last year we were physically separated, I left home with the children, on March 17 of last year. The reason for the separation was that I am a practitioner of the Islamic religion and my ex-husband did not allow me to practice it. The matter reached the point of physical and psychological violence. He persecuted me all the time, did not allow me to pray and this then led to the separation.

After a month, my ex-husband met the children every day, even taking them to school. Under the pretext that he was going to meet cousins ??who had come from abroad, he took them away and never returned them to me. At that moment, I started the divorce proceedings. I filed a preliminary injunction at the Durrës Court. I learned that he had filed a lawsuit at the Tirana Court on May 11 of last year. I filed a request at the Tirana Court for a temporary injunction to take the children, the judge rejected the first request, and I received no response to the second request. From the moment my ex-husband took them away, I met them very rarely, since I went to his house one day to meet them, since I had not seen them for more than a month, the moment I entered the house, the children hug me.

His sister starts cursing and insulting me and they both physically abuse me in front of the children, I got a protection order. Meanwhile, he and his sister get protection orders on the same day, in the same session. The session was held very quickly, no psychologist was assigned and no psychological report, no details were taken and nothing. I ask the show "Stop" to put the institutions in motion, so that I can complete the divorce process and take custody of the children, because I miss them very much, I miss them a lot, I have been away from them for over a year", said the citizen through tears.

From the ex-husband's conversations, it is clear his influence on the children and the offensive language he constantly uses towards the mother. He even says that he will tell the children that the mother has accepted, that he has a lover and wants to have other children with her.

Ex-husband: That's how you grew up, with bowls of rice on the streets, my race of sh…., my degenerate race, that you were. My female palacho. Don't give bowls of rice to the streets over there, may God slap your face, my idiot, my ignorant, that you were… I'll tell the boy, that he said F*** I have a lover, that's why I don't love you anymore. I'll make other jokes with the lover, I'll tell him, what he said.

Citizen: It's a court decision and that kind of decision has been in effect since December.

Citizen: Should I come and get the kids now and have them stay with me all dinner? Should they sleep at my place tonight?

Ex-husband: With the direction you're in, getting into trouble? That's not going to work.

Citizen: The children will stay with me, because they are my children too.

Ex-husband: My blood stays with you?

Citizen: Yes, they are my blood too.

Ex-husband: You will have a meeting with the toads once every two weeks or once a month, as the court decides.

Citizen: Who gives you this assurance that you will take custody of the children, because legally the custody belongs to me?

Ex-husband: You're not capable of custody, because you're on the highway.

Citizen: I am very capable, because I have a house, I work. I am in very good health.

The Kavaja social service said they were unaware of the termination of the protection order and would mediate so that the children could meet more with their mother.

"We, as the social service office of the Municipality of Kavaja, are aware of the lady's case. Some time ago, we had several meetings between the mother and the children, in the presence of the gentleman. Since we were not aware of the protection order, we were referred by you to the claim that the lady has, to meet her children more often. We, as the social service office, will enable more frequent meetings with the gentleman and the lady, so that we can agree that the lady will meet her children more often and not only on Fridays as it was before", said the Kavaja social service. Graciela Mana, a psychologist, states that the highest interest is that of the children and that the institutions must definitely take measures and draft psychological reports and then decide in their favor.

"I learned about the case and it is not normal for us to violate the highest interest, which is that of the child, which according to the law prevails first. In order for them to be as traumatized as possible by this entire, seemingly complicated process. Another thing that impressed me is the fact that a psychological assessment was not made. A protection order was issued, but the conditions of each of the children, their interests and what they have most were not taken into account. This is not just about fulfilling basic needs, but about fulfilling emotional needs and reducing as much as possible the traumatic experiences that mark the lives of these children and not only in the future. What I think has an impact here is the way one of the parents influences the other parent, through their opinions or judgments, which are personal judgments. Each of us is free to make our own choices in life, whether for affiliation, religious belief, but what I see as problematic is the way "how we approach children," said psychologist Graciela Mana.

Lawyer Orgesa Serani explains that a temporary measure should be taken and the children should stay with their mother, as they are very young.

"In this case, we are dealing with discrimination that began on the part of the husband against the woman, then it also began from other institutions and recently from the court. In this specific case, we do not have a mother who has created negligence in raising and educating the children, but we have a mother who is being discriminated against only because of her religious beliefs. In this specific case, the court, in all judicial processes that are conducted that are based on the best interest of the child, is obliged to appoint a psychologist. The court cannot express an indefinite opinion on a psychologist, even for a temporary measure. In this case, the court has not only discriminated against the woman, but has discriminated against the father of the children since it has decided without the decision of an expert that the children should stay with him. Currently, since we do not have a court decision that determines the mother's meetings with the children, the mother is free to meet the children whenever she wants and to make a compromise with the father of the children, for the custody of the children. In the event that the father does not accept a compromise, "We are at the stage where the mother must go back to court. In this specific case, if the mother of the children thinks that the court has taken a biased stance during this time, favoring her ex-husband, she can also file a request for the exclusion of the trial panel. Another trial panel should be appointed, which guarantees a fair legal process, to impose a temporary measure, to appoint a psychologist, and to take a stance," the lawyer explained./tvklan.al
