The Durrës Prosecutor's Office requests the sequestration of 20 assets, totaling 448,000 m2, which until 2018 were owned by the state and were illegally alienated.

The prosecution clarifies that under investigation are LK, as the deputy director of the Durrës Cadastre and the lawyers AK and MZ, which with their actions and inactions have resulted in the first creation of facilities and then the complete alienation of these assets.

"Specifically, the citizen AK, by acting as a lawyer in the Durrës ASHK for the "property" of the citizen L. Xh., has paved the way for, firstly, the confirmation of the falsified registration of this property and, secondly, the creation of conditions for its alienation, as it really happened only after a few days of her actions. While the MZ citizens and the deputy director LK clearly allowed the further alienation of the property with their actions. It turns out that they did not respect the established administrative links, excluding at least the person in charge of the area and the manager of ASHK from the control of the above-mentioned practices", the investigative file states.  

Notice of the Prosecution:

From the investigations of the prosecution, it turns out that there are suspicions based on evidence that actions/inactions were carried out by various persons, by means of falsified documentation as well as by employees of the ASHK, which led to the alienation of 448,000 m2 of land from property owned by the Albanian state in the property of individuals. Based on this fact, there are doubts that the criminal offenses provided by articles 143/3 and 25, 186, 248, 287 and 287/b of the Penal Code have been committed by as yet unidentified persons, bringing serious consequences, i.e. alienation of a total land area of ??448,000 m2, which is located in Cadastral Area no. 8517, Durrës.

In these conditions, since it is about objects that may continue to be alienated, in order to prevent other possible consequences that may come from their sale or the commission of other criminal offenses, the prosecuting body evaluates that a preventive seizure should be imposed on the following properties. According to the prosecution, the free disposal of these assets may aggravate or prolong the consequences of the criminal offense or may facilitate the commission of other criminal offenses.

For this reason, it was requested to set the measure of personal property insurance preventive seizure after the court accepted the requests of the prosecution on real estate namely:

Based on the above, the prosecuting body has proceeded with the registration of the names of the persons under investigation and specifically for the employees of ASHK Durrës, the citizens L. K as deputy director and the lawyers AK and MZ with their actions and inactions have resulted initially the creation of facilities and then the complete alienation of these assets. Specifically, the citizen AK performing actions as a lawyer in ASHK Durrës for the "wealth" of the citizen L. Xh. has paved the way for the first confirmation of the falsified registration of this property and secondly the creation of conditions for its alienation, as it actually happened only a few days after her actions. While the MZ citizens and the deputy director LK have obviously allowed the further alienation of the property by their actions. It turns out that they did not respect the defined administrative links, excluding at least the person in charge of the area and the head of ASHK from the control of the above-mentioned practices.

With their actions, these state employees, abusing their duties, have resulted in the stripping of the ownership of these land surfaces that belong to the Albanian state and their transfer to persons without rights.

Based on the above, the court accepted the request of the prosecutor's office and decided:

1. Appointment as an insurance measure against citizen L.Xh. suspected of committing the criminal offenses of "Fraud" and "Cleaning of the proceeds of a criminal offense or criminal activity" provided for by articles 143/3 and 25 and 287/2 letter"a" of the Criminal Code, that of "Arrest in prison ” provided by article 238 of K. Pr. Criminal.

2.                        Caktimin si masë sigurimi ndaj shtetases M.Xh, e dyshuar për kryerjen e veprës penale të “Përvetësimi i parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

3.                        Caktimin si masë sigurimi ndaj shtetasit K. Xh., i dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

4.                        Caktimin si masë sigurimi ndaj shtetasit Gj.N., i dyshuar për kryerjen e veprave penale të “Pastrimi I produkteve të veprës penale ose veprimtarisë kriminale” të parashikuar nga neni 287/2 germa”a” të Kodit Penal, atë të “Arrestit në burg”  parashikuar nga neni 238 të K. Pr. Penale.

5.                        Caktimin si masë sigurimi ndaj shtetasit D.T., i dënuar, ID nr.G31031047U, i dyshuar për kryerjen e veprave penale të “Mashtrimi” dhe “Pastrimi I produkteve të veprës penale ose veprimtarisë kriminale” të parashikuara nga nenet 143/3 e 25 dhe 287/2 germa”a” të Kodit Penal, atë të “Arrestit në burg”  parashikuar nga neni 238 të K. Pr. Penale.

6.                        Caktimin si masë sigurimi ndaj shtetasit Ë.T. i dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

7.                        Caktimin si masë sigurimi ndaj shtetasit K. T., i dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

8.                        Caktimin si masë sigurimi ndaj shtetasit Sh.T. i dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

9.                        Caktimin si masë sigurimi ndaj shtetases Sh.V. e dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

10.                    Caktimin si masë sigurimi ndaj shtetases B.B., e dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b e 25 të Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

11.                    Caktimin si masë sigurimi ndaj shtetasit K.K., i dyshuar për kryerjen e veprave penale të “Mashtrimi” dhe “Pastrimi I produkteve të veprës penale ose veprimtarisë kriminale” të parashikuara nga nenet 143/3 e 25 dhe 287/2 germa”a” të Kodit Penal, atë të “Arrestit në burg”  parashikuar nga neni 238 të K. Pr. Penale.

12.                     Caktimin si masë sigurimi ndaj shtetasit Ardit Kërtusha, I biri I Islam dhe I Merita, I dtl.12.01.1991, lindur në Durrës dhe banues në Lagja nr.15, Rruga “Aleksandër Goga” Durrës, me shtetësi Shqiptare, me arsim të lartë, gjendje familjare I martuar, gjendje gjyqësore I padënuar, ID nr.J10112072A, i dyshuar për kryerjen e veprave penale të “Mashtrimi” dhe “Pastrimi I produkteve të veprës penale ose veprimtarisë kriminale” të parashikuara nga nenet 143/3 e 25 dhe 287/2 germa”a” të Kodit Penal, atë të “Arrestit në burg”  parashikuar nga neni 238 të K. Pr. Penale.

13.                     Caktimin si masë sigurimi ndaj shtetasit O.Xh. i dyshuar për kryerjen e veprës penale të “Përvetësimi I parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale” të parashikuar nga neni 287/b i Kodit Penal, atë të “Detyrimit për t’u paraqitur në Policinë Gjyqësore”, 2 (dy) herë në muaj, të henën e parë dhe të tretë të çdo muaji në Prokurorinë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Durrës.

14. The appointment as a security measure against the AK citizen suspected of committing the criminal offense of "Abuse of Duty" provided by Article 248 of the Criminal Code, that of "Forcing to appear before the Judicial Police", 2 (two) times per month, on the first and third Monday of every month at the Prosecutor's Office near the Court of First Instance of the General Jurisdiction of Durrës.

15. The appointment as a security measure against the MZ citizen, suspected of committing the criminal offenses of "Abuse of Duty" provided by article 248 of the Criminal Code, that of "Prison arrest" provided by article 238 of K. Pr. Criminal.
