VKM/ Government approves the establishment of two photovoltaic parks in the

The Council of Ministers held its next meeting today where several decisions were made, including the construction of two photovoltaic parks in the Korça region.

A photovoltaic power generation plant and auxiliary works will be built in the Mbreshtan administrative unit in Kolonjë, by the company "TEKNO FIRE".

The other will be built in the Bilisht Center administrative unit in Devoll, by the company "KRONOS CONSTRUCTION".

The decision of the Council of Ministers states that the two photovoltaic parks will operate for 49 years from the entry into force of this decision.

FULL DECISIONS:

DECISION ON THE APPROVAL OF THE CONSTRUCTION OF A PHOTOVOLTAIC ELECTRICITY GENERATION PLANT AND AUXILIARY WORKS, WHICH IS NOT A CONCESSION OBJECT, IN THE ADMINISTRATIVE UNIT OF MBRESHTAN, MUNICIPALITY OF KOLONJA, KORÇA DISTRICT, BY THE COMPANY “TEKNO FIRE”, LLC

In accordance with Article 100 of the Constitution and point 1, Article 49, of Law No. 43/2015, “On the Electricity Sector”, as amended, upon the proposal of the Minister of Infrastructure and Energy, the Council of Ministers

DECIDED:

1. Approval of the construction of a photovoltaic power generation plant and ancillary works, which is not subject to concession and does not benefit from support measures, in the administrative unit of Mbreshtan, Municipality of Kolonjë, Korçë District, by the company "TEKNO FIRE", sh.pk, with the elements as follows:

a) Name of the applicant: Company "TEKNO FIRE", sh.pk;

b) NIPT/NUIS: L01307010S;

c) Type of power plant: Photovoltaic;

ç) Installed capacity: 102 MW;

d) Expected deadline for commissioning and obtaining a construction permit: The time for construction, obtaining a construction permit and commissioning the photovoltaic plant will be within 36 (thirty-six) months from the entry into force of this decision;

dh) Location of the energy generating source: In the administrative unit of Mbreshtan, Municipality of Kolonjë, Korçë District;

e) Operation period: 49 (forty-nine) years from the entry into force of this decision;

ë) Project coordinates according to Annex 1, attached to this decision;

f) The Ministry of Infrastructure and Energy and the National Agency of Natural Resources have the right to exercise general supervision, with 3-month deadlines during the implementation, commissioning and operation, with the aim of verifying that the progress of the works, quality, conformity and operation are in accordance with the general implementation program and project documentation;

g) The company "TEKNO FIRE", sh.pk, has the obligation to:

i. to periodically submit, every three months, to the Ministry of Infrastructure and Energy and the National Agency for Natural Resources information on the progress of the construction of the photovoltaic power plant;

ii. të respektojë kushtet e cituara në lejet, licencat dhe autorizimet paraprake mjedisore, lëshuar nga institucionet përgjegjëse kombëtare;

iii. të dorëzojë sigurimin e kontratës, në masën jo më pak se 5% të vlerës së investimit, përpara nënshkrimit të kontratës ndërmjet shoqërisë “TEKNO FIRE”, sh.p.k., dhe ministrisë. Në këtë kontratë përcaktohen të drejtat dhe detyrimet e palëve për realizimin e këtij projekti, penalitetet, në rast mosrealizimi, si dhe çështje të tjera që lidhen me zbatimin e saj;

iv. t’i japë falas, në formë royalty, ministrisë përgjegjëse për energjinë sasinë e energjisë elektrike, në masën 2 (dy) % të sasisë vjetore të prodhimit të energjisë elektrike ose konvertimin e saj në vlerë monetare. Në rast konvertimi në vlerë monetare, shuma duhet të derdhet tërësisht në buxhetin e shtetit;

v. të përmbushë kërkesën, sipas rastit, që një pjesë e prodhimit të burimit gjenerues të energjisë t’i shitet furnizuesit publik, sipas legjislacionit në fuqi.

2. Ngarkohen Ministria e Infrastrukturës dhe Energjisë dhe shoqëria “TEKNO FIRE”, sh.p.k., për zbatimin e këtij vendimi.

Ky vendim hyn në fuqi menjëherë dhe botohet në “Fletoren zyrtare”.

VENDIM PËR MIRATIMIN E NDËRTIMIT TË CENTRALIT GJENERUES TË ENERGJISË ELEKTRIKE FOTOVOLTAIKE DHE VEPRAVE NDIHMËSE, I CILI NUK ËSHTË OBJEKT KONCESIONI, NË AFËRSI TË FSHATIT VËRNIK, NJËSIA ADMINISTRATIVE QENDËR BILISHT, BASHKIA DEVOLL, QARKU KORÇË, NGA SHOQËRIA “KRONOS KONSTRUKSION”, SH.P.K.

Në mbështetje të nenit 100 të Kushtetutës dhe të pikës 1, të nenit 49, të ligjit nr.43/2015, “Për sektorin e energjisë elektrike”, të ndryshuar, me propozimin e ministrit të Infrastrukturës dhe Energjisë, Këshilli i Ministrave

VENDOSI:

1. Miratimin e ndërtimit të centralit gjenerues të energjisë elektrike fotovoltaike dhe veprave ndihmëse, i cili nuk është objekt koncesioni dhe nuk përfiton nga masat mbështetëse, në afërsi të fshatit Vërnik, njësia administrative Qendër Bilisht, Bashkia Devoll, Qarku Korçë, nga shoqëria “KRONOS KONSTRUKSION”, sh.p.k., me elementet, si më poshtë vijon:

a) Emri i aplikuesit: shoqëria “KRONOS KONSTRUKSION”, sh.p.k.;

b) NIPT/NUIS: K41416033P;

c) Tipi i centralit: fotovoltaik;

ç) Kapaciteti i instaluar: 50MË;

d) Afati i pritshëm i vënies në punë dhe pajisja me leje ndërtimi: koha për ndërtimin, pajisjen me lejen e ndërtimit dhe vënien në operim të impiantit fotovoltaik do të jetë brenda 36 (tridhjetë e gjashtë) muajve nga hyrja në fuqi e këtij vendimi;

dh) Vendndodhja e burimit gjenerues të energjisë: në afërsi të fshatit Vërnik, njësia administrative Qendër Bilisht, Bashkia Devoll, Qarku Korçë;

e) Afati i operimit: 49 (dyzet e nëntë) vjet nga hyrja në fuqi e këtij vendimi;

ë) Koordinatat e tokës dhe planvendosja sipas aneksit 1, që i bashkëlidhet këtij vendimi;

f) The Ministry of Infrastructure and Energy and the National Agency of Natural Resources have the right to exercise general supervision with 3-month deadlines during the implementation, commissioning and operation, with the aim of verifying that the progress of the works, quality, conformity and operation are in accordance with the general implementation program and project documentation;

g) The company "KRONOS CONSTRUCTION", sh.pk, has the obligation to:

i. to periodically (every three months), submit to the Ministry of Infrastructure and Energy and the National Agency for Natural Resources, information on the progress of the construction of the photovoltaic power plant;

ii. to respect the conditions cited in the permits, licenses and prior environmental authorizations issued by the responsible national institutions;

iii. to submit the contract security, in the amount of not less than 5% of the investment value, before signing the contract between the company “KRONOS KONSTRUKSION”, sh.pk, and the ministry. This contract defines the rights and obligations of the parties for the implementation of this project, penalties in case of non-implementation, as well as other issues related to its implementation;

iv. to provide free of charge, in the form of royalty, to the ministry responsible for energy the amount of electricity, at the rate of 2 (two) % of the annual amount of electricity production or its conversion into monetary value. In the case of conversion into monetary value, the amount must be paid entirely into the state budget;

v. to comply with the requirement, as applicable, that a portion of the production of the energy generating source be sold to the public supplier, in accordance with applicable legislation.

2. The Ministry of Infrastructure and Energy and the company "KRONOS KONSTRUKSION", sh.pk, are charged with the implementation of this decision.

This decision enters into force immediately and is published in the "Official Gazette". / CNA
