As today the measure was to be given in the GJKKO for the directors and officials of the Municipality of Tirana, who are accused of corruption and abuse of power for the "5D" file, the session in the Special Court has been interrupted.

On Thursday, by order of SPAK, Mariglen Qato, former director of Support Services at UKT Tirana, and Redi Molla, former director of Tirana Water and Sewerage, were arrested. Meanwhile, SPAK issued another arrest warrant for Taulant Tusha. The latter is behind bars for the affair in Tirana's incinerator, while Fud's arrest warrant comes within the file "5D" - 5 Directors.

The Special Court has imposed the security measure "obligation to appear" for the officers and directors: Enton Punavija, Julian Zanaj, Albano Janku, Nestor Muhamellari, Eglantina Zere and Deborah Keçi.

From SPAK's investigations it has been found that Redi Molla and Mariglen Qato are the real partners and "de facto" owners of the company "5D Konstruksion" sh.pk Molla and Qato have owned this trading company indirectly, using persons others, EM, MP and NM citizens, as fictitious partners in the acts of registration and operation of the company, with whom the real partners of the company had social ties and friendly ties.

According to SPAK, during the period 2016-2020, when Redi Molla as the General Director of the company "Ujjesjellës Kanalizime Tirana", the trading company "Igor Elektrik" the same as "VAS Konstruksion", the same as "5D Konstruksion" sh.pk, participated and was declared the winner in violation of public procurement rules in 7 (seven) procurement procedures, carried out by the contracting authority "Ujësjellës Kanalizime Tirana" sh.a.

In these procedures, Redi Molla had the capacity of the holder of the contracting authority, ordered the performance of the procurement, ordered the composition of the Procurement Unit, ordered the composition of the Bid Evaluation Commission (appointing in four cases as a member of this commission Mariglen Qaton , which is the other indirect partner of the company). In the meantime, he has signed business contracts, as well as performed any other action related to the capacity of the holder of the contracting authority, with the commercial company in his possession.

Likewise, during the years 2016-2018, when Mariglen Qato exercised the function of the Director of the Support Department in the company "Tirana Water and Sewerage", the above commercial entity participated and won in violation of the public procurement rules in 4 (four) procedures procurement.

SPAK emphasizes that it has been proved by facts that the company "VAS Konstruksion" sh.pk, the same as "5D Konstruksion" sh.pk, participated and was declared the winner in violation of the public procurement rules, in some procurement procedures organized by the contracting authority Tirana Municipality.

This is where Taulant Tusha comes into play.

The latter, while holding the post of General Director of the Public Works Planning Directorate and member of the Bid Evaluation Commission, collaborated with Enton Punavijë, Julian Zanaj and Albano Janku.

SPAK also has evidence for Eglantina Zeren, who, as the holder of the contracting authority "Tirana Parking", favored the economic operator "VAS Konstruksion sh.pk" in a procurement procedure, the same as "5D Konstruksion" sh.pk , creating unfair advantages and privileges, as well as declaring her the winner in an irregular manner.

The latter also had communications with Nestor Muhamellar, administrator of the company "5D Konstruksion" sh.pk and the evaluation of the offers of the participants in the tenders was done by employees of the company "5D Konstruksion" sh.pk.

In the same way, Deborah Keçi, in the capacity of the holder of the contracting authority Sports Club "Tirana", has favored the economic operator "VAS Konstruksion sh.pk" in a procurement procedure, the same as "5D Konstruksion" sh.pk, creating advantages and privileges for unfairly, as well as declaring her the winner irregularly.
