KPA upholds KPK decision on legal assistant Jurida Bajraktari

The Special Appeals Commission has upheld the decision of the Independent Qualifications Commission for the confirmation of the legal assistant at the Administrative Court of Appeal, Jurida Bajraktari.

The decision was made at today's meeting by a judging panel composed of Albana Shtylla as chairperson, Ina Rama as rapporteur, Mimoza Tasi, Rezarta Schuetz, Sokol Çomo as members.

"The adjudicatory panel of the Special Appeals Chamber, composed of Albana Shtylla as presiding judge, Ina Rama as rapporteur, Mimoza Tasi, Rezarta Schuetz, Sokol Çomo as members, announced the decision on case no. 51/2023, dated 06.11.2023, which concerns the appeal of the Public Commissioner against the decision of the Independent Qualification Commission no. 701, dated 25.09.2023, relating to the subject of re-evaluation Jurida Bajraktari.

At the end of the trial, the panel, based on Article 66, point 1, letter “a” of Law No. 84/2016, “On the temporary re-evaluation of judges and prosecutors in the Republic of Albania”, unanimously decided:

"Enforcement of the decision of the Independent Qualification Commission no. 701, dated 25.09.2023, concerning the re-evaluation subject Jurida Bajraktari. This decision is final and has immediate effect. It was announced today, on 09.02.2026, in Tirana," the KPA announcement states.

The Independent Qualification Commission (IKC) found problems in the professional aspect of legal assistant Jurida Bajraktari, as well as the fact that she had applied for the position she holds without meeting the seniority criterion.

These reasons were not found to be penalizing by the Commission and the subject was suspended from duty, as well as her obligation to complete a one-year training at the School of Magistrates. A year later, on September 25, 2023, based on the "good" result achieved at the end of the training, the KPK confirmed her in duty. /CNA
