Saimir Vishaj: Criminal amnesty to be extended until February, there are many

Renowned lawyer Saimir Vishaj shared today a legal analysis regarding Criminal Amnesty.

Invited to "Syri TV", Vishaj emphasized that there are many interpretations of this aspect, and he stated that this deadline should be closer to the end of February and not until the end of 2025, not even hiding people who have criminal convictions.

"If not, without evidence, go, take him and directly arrest him, especially when a person comes every time he calls, appears before the prosecutor's office and the court, the police on the other hand take him to prison in absentia and go in the middle of the night with a hood and traumatize him and his family as if he were a criminal and not a lawbreaker who has committed a criminal offense."

They are not done unintentionally, they are on purpose. Because in the specific case when arrests are made, people are considered objects and numbers. And when they report to the bosses, they say we have arrested 100 objects, 200 objects, they turned the person into an object.

When it is known that keeping a person in prison costs, not only in monetary terms, but also 350, 400 euros, which we could throw into kindergartens or give to pensioners.

As for the amnesty, this will also have many interpretations, because on the one hand, the amnesty itself excludes criminal offenses convicted by SPAK. Yes, SPAK has a structured group in one offense, one for corruption, the others for abuse of office and failure to report a crime. Abuse of office and failure to report a crime is not the competence of the special prosecutor's office. And there is no reason why it should not benefit.

It is enough that SPAK has convicted him and this person does not benefit. So, we do not have equality of parties, as those from the courts of general jurisdiction benefit, so that these also benefit.

One of the first points of the amnesty is that the person must have been convicted. Yes, 60% of people who did not agree with the first instance decision have filed an appeal.

They have filed an appeal and they must necessarily withdraw the appeal for the first instance decision to be considered final. But we still don't know. It is said that the amnesty will be issued within two weeks, it has been issued for three weeks, but those who have committed criminal offenses until December 31, 2025 will benefit.

While this first deadline should be approaching, it should be February 28th, and the second one should be with the people who are hiding. There are many people who are hiding intentionally, but there are also many people who do not know that they are being charged with a criminal offense.

"Only when they come to the border crossing points, come on, you have to do two years in prison, you have to do three years. That's why I say that this entire layer of people who were sentenced in absentia should have been included in the amnesty. Just as people with life imprisonment should have been included," said Vishaj./CNA
