Government representative, Herald Jonuzaj, in the session held at the Constitutional Court regarding the appeal for Balluk's suspension, said that the Council of Ministers cannot delegate the task from one minister to another.

Jonuzaj said that in the case of a minister's suspension, the portfolio would need to be transferred, which would lead to a restructuring.

Another option, Jonuzaj said, is for the ministry portfolio to be taken by the prime minister, which would lead to the minister's dismissal.

Focusing on the prohibitory measure, Jonuzaj said that it must be authorized by the Assembly, as the Constitution is clear, it cannot be violated in the exercise of its activity.

Jonuzaj stated that granting authorization from the Assembly ensures the balance of powers.

 

" The Council of Ministers cannot delegate the task from one minister to another. It would require a transfer of the portfolio, which would entail restructuring, or the Prime Minister would take over the portfolio, which would de facto result in a dismissal. A prohibitory measure against a minister must be authorized by the Assembly. The Constitution has determined that a minister cannot be interfered with in the exercise of his activity. The granting of authorization by the Assembly ensures the balance of powers ," said Jonuzaj.
