Formula 1 in Albania/ Government decides to expropriate owners for track

The Council of Ministers decided today to expropriate the owners whose property is affected by the "Auto Moto Park" project in Elbasan, where a track for the development of "Formula 1" races is expected to be built.

The value of these expropriations amounts to around 3.5 million lek.

The decision took effect immediately.

 

Government Decision:

EXpropriation, FOR PUBLIC INTEREST, OF THE OWNERS OF REAL ESTATE, PRIVATE PROPERTY, AFFECTED BY THE REALIZATION OF THE “AUTO – MOTO PARK” PROJECT, ELBASAN MUNICIPALITY

In accordance with Article 100 of the Constitution and Articles 5, 20 and 21 of Law No. 8561, dated 22.12.1999, “On the expropriation and temporary use of private property for public interest”, as amended, upon the proposal of the Deputy Prime Minister and Minister of Infrastructure and Energy, the Council of Ministers

DECIDED:

1. Expropriation, in the public interest, of the owners of real estate, private property, affected by the implementation of the "Auto - Moto Park" project, Elbasan Municipality.

2. The expropriation is made in favor of the General Directorate of Road Transport Services.

3. Owners of immovable property, private property, that are expropriated, shall be compensated in full value, according to the relevant measure, which is presented in the table attached to this decision, for property of the type "land", with a total value of 347 372 260 (three hundred forty-seven million three hundred seventy-two thousand two hundred sixty) lek.


4. The total value of the expropriation, of 347,372,260 (three hundred forty-seven million three hundred seventy-two thousand two hundred sixty) lek, is borne by the state budget, the “Expropriation Fund” account, at the Bank of Albania.

5. The value of the procedural expenses, in the amount of 70,000 (seventy thousand) lek, shall be borne by the General Directorate of Road Transport Services.

6. The expropriation begins immediately after the publication of this decision in the "Official Gazette" and the deadline for completing the expropriation is within 3 (three) months from the date of its entry into force.

7. Owners of immovable property, private property, reflected in the table attached to this decision, are compensated, for the purpose of expropriation, after having submitted the justifying documentation for liquidation to the State Agency for Expropriation.

8. The State Agency for Expropriation carries out the procedures for the liquidation of expropriated owners, according to the provisions made in this decision.

9. The deadline for the start and completion of the works is in accordance with the deadlines set by the General Directorate of Road Transport Services.

10. The State Cadastral Agency, Elbasan Local Directorate, within 30 (thirty) days from the date of approval of this decision, initiates the procedures for laying the project footprint on the cadastral map, according to the approved expropriation plan, and registers the act of transfer of ownership in favor of the state, under the administrative responsibility of the Ministry of Infrastructure and Energy, for the General Directorate of Road Transport Services, for the expropriated property, according to this decision.

11. The State Cadastre Agency suspends all transactions with the expropriated assets until the completion of the process of laying the project footprint on the cadastral map and registers the act of transfer of ownership in favor of the state, under the administrative responsibility of the Ministry of Infrastructure and Energy, for the General Directorate of Road Transport Services, for the expropriated assets, according to this decision.

12. The Ministry of Infrastructure and Energy, the Ministry of Finance, the General Directorate of Road Transport Services, the State Cadastre Agency, the Elbasan Local Directorate, and the State Agency for Expropriation are charged with the implementation of this decision.

This decision enters into force immediately and is published in the "Official Gazette"./ CNA
