Suspected to be derived from criminal activity/ Tirana Prosecution requests

The Tirana Prosecution Office has requested the confiscation of the assets of citizen Elton Arkaxhiu, who has been convicted in France for the criminal offense of 'Drug Trafficking', and of persons associated with it.

Based on the wealth investigation, Arkadjiu's assets are not justified from an economic point of view. There are also suspicions that the assets derive from criminal activity.

According to estimates, the assets amount to hundreds of thousands of euros.

The Tirana Prosecution Office is requesting the confiscation of the assets of citizen EA, convicted in France for the criminal offense of 'Drug Trafficking', and of persons associated with him.

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, requests the confiscation of the assets of citizen EA, convicted in France for the criminal offense of 'Trafficking in narcotics', and persons associated with him.

From the investigations into property proceedings no. 03 of 2024, it was identified that the assets of citizen EA are not justified from an economic point of view and are suspected of deriving from the criminal activity of this citizen.

From the financial analysis and the administered documentation, it resulted that, for the period when the assets were located, especially the years 2005-2010, citizen EA and the persons related to him, specifically his brother BA, were objectively financially unable to afford the purchase of the service unit with an area of ??108 m² and the property with no. 5/255, since the total legal income (salary, pensions, commercial activity, loans, loans and other income) is significantly lower than the total of the investments and expenses ascertained, creating negative differences resulting from the expert report, which makes it impossible for these assets to have been financed from legal sources.

Likewise, for citizen AM, who according to the notarial declaration claims ownership of the service unit with an area of ??63 m², the analysis shows that at the time of the creation of the 63 m² property in 2005-2006 he was financially insolvent, resulting from the expert report, so these later incomes cannot justify the source of the property at the time of purchase. Also important is the statement of the administrator of the company “INA” sh.pk, who explained that BA himself was present in all cases when making payments for both contracts, while he was unable to share AM’s participation in these payments. AM’s lack of financial ability at the time of the creation of the property, together with the declarations that the payments were actually made by BA, constitute useful data that create a reasonable suspicion that the 63 m² property is not in the possession of AM, but of EA.

For these reasons, based on articles 3-7, 11, 12, 12/a 21, 22, 24 and following of law no. 10192, dated 03.12.2009 "On the prevention and suppression of organized crime, trafficking and corruption through preventive measures against property", the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana requests the confiscation and transfer to the state ownership of the following immovable properties:

– Property of the type of land, with surface area 71/.52 m2 and building 37.52 m2, with no. 5/255, registration number 8380. This property was purchased on 04.08.2010, according to the purchase contract for the value of 9 332 800 lek and is currently owned by citizen EA;

– The property acquired by citizen BA (a person related to the subject-brother), a 108 m2 service unit, worth 210,000 euros; and

– The property acquired by citizen BA, (person related to the subject-brother), 63 m2 service unit, worth 126,000 euros. /CNA
