Constitutional Court Decision/Beçi: Here is the situation from a legal

Former prosecutor Eugen Beçi explained today how the proceedings were conducted and what today's decision of the Constitutional Court shows. 

In a television show, Beçi stated that in this case we are not dealing with a cancellation, but rather a suspension of the decree.

Beçi also specifically mentioned the political point of view, while also focusing on legal practices in the country.

"The Constitutional Court, seeing that the institutions did not comply with the Constitution, and referring to Veliaj's request, has decided to partially suspend the President's decree. The suspension also responds to the part, the elections were not suspended, but the decree. This suspension will be in force until the Constitutional Court expresses its opinion on the merits of Veliaj's appeal for dismissal.

Then the decree is suspended. This is a kind of lawsuit insurance. We are not dealing with annulment, but suspension of the decree.

Will there be elections? I say this with all my heart, elections cannot be held in Tirana on November 9. Even if the session on October 31 is held, it will take up to 30 days for the decision. If on October 31, all parties appear, the law recognizes the right to a decision within 30 days. Theoretically and practically, there are no elections on November 9. Politically, we have a precedent, that the President canceled the elections by decree and this decree was not taken into account by the government and the CEC.

From a political point of view, the CEC and the government can say and hold elections.

We have a practice of the CC, where there are four decisions of the CC that refer to due process. If the CC considers it irregular, it can return the procedure and start it in the Municipal Council or the Council of Ministers. The process can be returned but it does not oblige politically to say you will not dismiss him.
