The submissions that the President of the Republic has sent to the Constitutional Court regarding the request made by Erion Veliaj to oppose the dismissal of the mayor are being clarified.

In the submissions of the President of the Republic, it is stated that Erion Veliaj has been dismissed from office under Article 62, point c, of the Law on Local Self-Government. This article includes dismissal from office after a three-month absence from work.

A provision that petitioner Erion Veliaj calls unconstitutional.

Erion Veliaj, in his appeal, requested that his dismissal be based on Article 115 of the Constitution.

But Erion Veliaj cannot be dismissed based on this article, because in order for Article 115, point 1, of the Constitution to be used for the "Veliaj" case, then the first paragraph of Article 115 should not have contained the phrase "for serious violations of the Constitution and laws".

Only in this case, this provision could apply to all cases of dismissal listed in Article 62 of the Law on Local Government.

Regarding Article 62 of the law on local government, the Presidency's material clarifies that according to petitioner Veliaj, letters b) and c) cannot be used even though they are in the law, because they are unconstitutional.

So for petitioner Veliaj to be right, Article 115 of the constitution and Article 62 of the local government law must be rewritten differently.

Erjon Veliaj was not dismissed for violating the Constitution and the Laws.

It is not clear why Veliaj is so keen to be dismissed for serious violations of the Constitution and laws.

Veliaj was dismissed because, regardless of the motive, he is unable to perform the duty for which he was elected.

Veliaj wants to be dismissed under Article 115 of the Constitution, but the state has laws that prevent the dismissed person from being dismissed for whatever reason./ CNA
