The President of the Constitutional Court, Holta Zaçaj, has slapped the Assembly regarding the case of former minister Olta Xhaçka, at a time when the opposition is demanding that the decision of the institution she leads be implemented.

Zaçaj told the Voice of America that the non-implementation of the decision on the mandate of the former minister is an unusual situation and impossible to happen in a democratic state.

Among other things, Zaçaj emphasized that every decision of the Constitutional Court must be implemented.

"It is a question, in fact, repeated for the Court and for me personally in my appearances in the media. It is really an unusual and impossible situation to happen in a democratic state. I have mentioned it other times - the decisions of the Constitutional Court must be implemented and the implementation of the decisions of the Constitutional Court constitutes, in fact, the implementation of the Constitution itself. So words are too much to convey a message beyond what I just said. Every decision must be implemented. There is no other way, there is no other mechanism, and the reason why there is no other mechanism is because it is impossible to imagine that the decisions of the Constitutional Court will not be implemented, so there is not much left to interpret at this moment," said Zaçaj .

We recall that the Constitutional Court in January 2023 annulled as unconstitutional the decision of the Assembly to block the sending for interpretation to this court of Xhaçka's mandate, after her husband was declared a "strategic investor" and benefited, among other things, through a government decision, from the use of the coasts of the sea.

This decision of the Constituent Assembly for the mandate of the socialist deputy remains unimplemented. The issue of Xhaçka's mandate is held in the office of Nikola, who has the legal authority to decide on the further parliamentary procedure that will follow the implementation of the decision of the Constitutional Court.

Xhaçka's mandate has been called into question due to the benefit of her husband, Artan Gaçi, from the status of a strategic investor for a hotel in Dhërmi, as well as the permission to use the beaches in front of the hotel.

Meanwhile, the Special Prosecutor's Office, SPAK, has imposed a measure of preventive seizure on a land area of ??5512 m2 owned by Gaç on the coast, as it is suspected that it was obtained through forged documents./ CNA
