Attorney Genc Gjokutaj spoke about today's hearing on the case of former Prime Minister Sali Berisha and its postponement to December 30, 2023.

Invited to the show "Task Force" with the moderator Sonila Meço, Gjokutaj stated that bias was found on the part of judge Irena Gjoka and her dismissal was requested.

The lawyer emphasizes that Irena Gjoka has violated the Constitution, since in 1996 she was dismissed by Berisha when she held the position of the head of the KLD.

"If we talk about a criminal process, the basis of a process is the procedure and neither more nor less the procedure is the standard of a process and shows the path followed by the parties and is the guarantee for an orderly judicial process. We have requested the dismissal of judge Gjoka and the report against her for the constitutional violation from the beginning where she appears as dismissed from the KLD in 1996 when Berisha was the head of that body. Yesterday we found bias as it started from the beginning of this process and I raised the request for her exclusion.

I saw a surprise today where the court has respected a three-day deadline since it is vulnerable in the Appeal and has respected this three-day deadline and set the date of the announcement. We have to file the motion to dismiss the judge and then proceed with the announcement of the decision.

Yesterday we raised the request but we did not file it in writing and this morning I showed up to receive the documentation and until Saturday we have the deadline to file this deadline.

Saturday at 12 o'clock is the time for the announcement of the decision and we do not know if it is conditional on the judgment of the request for her exclusion. If the request for exemption is approved, then the trial starts from the beginning and this whole procedure that was used up now starts again from the beginning", said Gjokutaj./ CNA
