It happened several times that Ms. Xhacka, sometimes with friendship, sometimes with anger, and sometimes with love, violated the civil rights of the public. Her history begins as a bride with the rental company "Gjallica" and continues to live today as a bride with the use of the coast for tourism by her strategic husband!
Minister Xhaçka is accused of having acquired land on the coast in the name of her husband, using the closeness in the government to the Prime Minister, to his brother, to the family circle that today is a member of the SP.
But according to Rama, Olta Xhaçka's husband has rightfully claimed that the part of the beach in front of his property belongs to him by law!!! Rama does not see any reason for this "storm in a glass"!!! It's the talk of a mental fool - he says further!
Meanwhile, in her speech next to Rame, Olta Xhacka excuses herself and asks to open the umbrellas on the coast, "opening" our stomachs for once!
With the help of the public, the media, and politics, I am re-acquainting them with the approved Manual on the conflict of interests.
WHAT IS CONFLICT
OF INTEREST AND LEGAL PROHIBITIONS?
Since 15 years ago, with the financial support of USAID, the Albanian Center for Economic Research (ACER) has assisted ILDKPI in the preparation of Manual No. 2: "MANUAL ON PREVENTING CONFLICT OF INTEREST IN PUBLIC PROCUREMENT". Precin)
In this document, which is effective in implementing the relevant law and can be easily found on the ILDPI website (https://www.ildkpki.al/gloolsys/2018/12/manual-pki-nr.2-.pdf) , precisely on pages 37-39 some essential clarifications are given.
This is how it is clarified who are the "related persons", as well as the cases of absolute prohibitions, ("absolute nature prohibition"; refers to prohibitions arising from the function of the official, points 1, 2, and 6 of article 21 of the PKI law) .
It also clarifies what is considered a public contract (see the quotation below).
Quote:
"The persons related to the official are the spouse, adult children and the parents of the official and the spouse".
In the following I am quoting the relevant summary found on page 39:
At the end of the above analysis, it can be said that the main elements of the prohibition of an absolute nature are:
1. this type of prohibition is related to the function of the official and applies to the category of officials of central public administration institutions
2. the prohibition is of an absolute nature , due to the fact that it is not related to the concrete decision-making of the official in the conclusion of a public contract, but is only related to his exercise of the public function according to the categories described above
3. the absolute prohibition in the conclusion of contracts for these categories of officials, extends throughout the territory of RSH, for all public institutions
4. public contracts are considered procurement, auction, concession and in this sense, high-level officials, to whom the absolute ban on concluding contracts applies, cannot benefit in any of these cases
5. prohibitions for high-level officials , in the same way and to the same extent, are also applied to the persons related to the official (spouse, adult children and parents of the official and the spouse. These conclusions are valid for all categories of officials that are treated in this chapter, i.e. for:
1. high-level officials of central institutions
2. elected and high-level officials of local government bodies
3. officials, members of Regulatory Authority bodies
4. persons related to the officials of the above categories, in the sense of Article 24 of the PKI law.
