The Constitutional Court has decided to review Erion Veliaj's lawsuit on October 31. A session that should have ended with the rejection of the complaint for lack of competence turned into a session where the Constitutional Court itself violated the Constitution.
Professor Sadushi, who writes lectures on administrative law in the media, would have given them a grade of 4 on that occasion, even if it were a friend.
Beyond the flagrant violation, the Constitutional Court, with its decision to suspend the Presidential Decree, which announced the Elections in Tirana on November 9, has 'de facto' postponed the elections for Mayor of Tirana.
Tirana was re-sentenced by constitutional judges not to elect a Mayor on November 9. There is no deadline for when the Constitutional Court will decide to appoint a new Mayor, because October 31 is simply the date when the members of the Constitutional Court will be called to convene. But they then have up to 30 days to gather themselves before announcing the decision.
Tirana, which has been without a mayor for 9 months, has this time also become a victim of the complexes that the existing members of the Constitutional Court regularly experience whenever they have to act as constitutional judges.
No one can believe that the Constitutional Court will overturn the decision of the Council of Ministers to dismiss Erjon Veliaj!

The Constitutional Court cannot say to Tirana: "You will remain without a president, because we were born without courage and without a profession."
The Constitutional Court, with its interim decision (also taken in excess of its powers), irresponsibly managed to postpone the elections in Tirana.
The President's decree found them unprepared, because with the style of a man who is afraid of his own shadow, when they received Veliaj's complaint about the decision of the Council of Ministers, everyone hid under the tables. They would have stayed there for a long time, but how unfortunate that the President's decree required them to gather within 10 days!
Instead of enforcing the law that tells them: "It's not your job to intervene when the mayor is unable to go to work for 3 months in a row," they panicked.
The mayor is ONE PERSON.
It is not the case of 140 deputies when a reason for the absence is required. In the case of a deputy when one is absent, there are 139 others standing and the body functions without restriction.
When the Mayor is absent, elections must be held.
In the panic of the panicked Constitutional Court, they cannot even read Veliaj's own appeal.
Veliaj's lawyers, in their appeal against the decree, write it themselves and refer to the decision of the Constitutional Court that determines the Decree on the date of the Elections as an individual act. So, it is appealed to the Administrative Court.
But since the defendant (meaning "uneducated" this time), cannot even trust himself, the members of the Constitutional Court cannot trust Veliaj either.
And they suspended the execution of an act that they have no authority to review. (Professor Sadushi will have his hair standing on end.)
One thing cannot change. The elections in Tirana will take place! The criminal incompetence of the members of the Constitutional Court simply postponed them, but cannot cancel them.
Only if they undertake, as they did with the President's decree, to decide that the Mayor should be released from prison for a while because he has some papers to sort out.
If they cannot get Veliaj out of prison, then they should release the elections that they criminally postponed, without any legal or Constitutional competence.
