Special Court orders continued detention for Thaçi and 3 other defendants

The Kosovo Specialist Chambers in The Hague have ordered the continuation of the detention measure against Hashim Thaçi, Isni Kilaj, Bashkim Smakaj and Fadil Fazliu.

The decisions for Thaçi, Kilaj, Smakaj and Fazliu were made separately for each of those involved.

“In light of the above and in the absence of any intermediate information to the contrary, the Pre-Trial Judge concludes that the risk of flight in relation to Mr. Thaçi continues to exist.

The pre-trial judge concludes that there continues to be a risk that Mr. Thaçi will obstruct the progress of the DSK proceedings.

None of the conditions then proposed by Mr. Smakaj's Defence, nor any other condition imposed proprio motu, could sufficiently mitigate the existing risks, particularly the risks of hindering the progress of the DSK proceedings and the commission of further criminal offences.

Also, for Kilaj, the pre-trial judge found that there are credible reasons that he could flee, obstruct the proceedings of the Kosovo Security Force and commit other crimes.

The Pre-Trial Judge concludes that the conditions for Mr. Kilaj’s release, previously proposed by the Defence and/or any additional reasonable conditions imposed by the Pre-Trial Judge, remain insufficient to adequately mitigate the risks under Article 41 (6) (b) (i)-(iii) of the Law,” the decision states.

Former Kosovo President Hashim Thaçi, former Kosovo MPs Kadri Veseli and Jakup Krasniqi, and former head of the Vetevendosje Movement (LVV) MPs, Rexhep Selimi, are accused by the Specialized Prosecutor's Office (ZPS) for events in the period between 1998–1999./CNA
