Ridiculous amount/ How the apartment on Kavaja Street ended up in the hands of

SPAK has seized the assets of former AKSHI director Mirlinda Karçanaj. Karçanaj is suspected of having illegally acquired some assets.

After the investigations showed how she benefited from the apartment on Dervish Hima Street in the middle of Tirana, CNA is bringing the investigations that have been conducted in relation to another apartment that is suspected of having been benefited from by Karçanaj, as a direct product of the criminal offense of passive corruption by the investigator, as a result of her actions in her capacity as the head of the AKSHI institution.

It concerns the property:  ZK: 8380, Property: 6/10+5-45, Map Index: TR-O-11, Volume: 5, Page: 47, specifically the property located on “Kavajës” street, with an area of ??73.5 m2.

According to the data in the file provided by CNA, from the review of the ASHK and RNSH system, for real estate owned by citizen Mirlinda Karçanaj, it has resulted that, among other things, in the "new archive" section, in the documents for citizen Mirlinda Karçanaj, the real estate with the above data is recorded. (ZK: 8380, Property: 6/10+5-45, Map Index: TR-O-11, Volume: 5, Page: 47 specifically the property located on "Kavajës" street, with an area of ??73.5 m2.)

How did the property end up with Mirlinda Karçanaj's family?

The data in the investigative file provided by CNA shows step by step how the sales and purchases of this property were made.

Part of the investigation file

From the review of the RNSH system it results that in 2017, a Sales Contract was signed, with no. Rep: 303 and no. kol: 130, dated 08.03.2017, with the seller: Bledar Ilir Likaj and the buyer: Rafael Merçan Bistri, with 2 (two) sheets. The sales contract stipulates that the apartment in cadastral zone 8380, with property no. 6/10+5-45, vol.5, p.47, with an area of ??73.5m2, located on "Kavajës" street, will be sold for the amount of 78,380 (seventy-eight thousand three hundred and eighty) euros, the amount of which will be transferred to the account of citizen Marlind Ilir Likaj, at BKT.

Subsequently, in the RNSH system, an in-depth verification was carried out for notarial acts signed by citizen Rafael Merçan Bistri (the buyer of this property), from 2017 onwards, which resulted in the following notarial acts of interest:

Loan contract, with no. 1773 rep and 622 col, dated 07.03.2017, with the lending party the commercial company "Forensic-Lab", represented by the administrator Erisa Malenllari, with the object of granting an interest-free loan, in the amount of 30,000 (thirty thousand) euros, to the borrower Rafael Bistri, with a term until 07.03.2019.

Loan contract, with no. 1773 rep and 622 col, dated 07.03.2017, with the lending party the trading company "Fastech" sh.pk, represented by the administrator Andis Papa, with the object of granting an interest-free loan of the amount of 50,000 (fifty thousand) euros, to the borrower Rafael Bistri, with a term until 07.03.2019.

Sale and purchase contract (real estate), with no. 399 prot and 124 col, dated 30.05.2018, with the selling parties Rafael Bistri and Eda Bistri (wife), and the purchasing party Mrs. Enxhi Shima, with the object: sale of real estate of the type "Apartment", with property no. 6/10+5-45, cadastral zone 8380, with surface area 73.5 m2, with address "Kavajës" street, h.5, k.4, ap 45, Tirana, in the amount of 48,000 (forty-eight thousand) euros.

From the analysis of the documentation cited above, it is documented that on March 7, 2017, citizen Rafael Bistri borrowed the amount of 80,000 (eighty thousand) euros from Erisa Malenllari and Andis Papa, and on March 8, 2017, he signed the contract for the sale and purchase of immovable property, property which, it turns out, this citizen sold about 1 year later, through the Contract of Sale (immovable property), with no. 399 prot and 124 col, dated 30.05.2018, to citizen Enxhi Shima (sister of citizen Daniel Shima).

What happens after this?

Citizen Enxhi Shima, Daniel Shima's sister, has entered into a sales contract with Gjenovefa Karçanaj, who is the mother of Mirlinda Karçanaj.

This property was purchased for a value of 5,000,000 (five million) new lekë. The same apartment, which was purchased by citizen Rafael Bistri for the amount of 78,380 (seventy-eight thousand three hundred and eighty) euros in March 2017 (with funds received from Erisa Malenllari and Andis Papa), was sold to the mother of citizen Mirlinda Karçanaj (Gjinovefa Karçanaj), in May 2019, for a value of 5,000,000 (five million) lekë, i.e. about 3,000,000 (three million) lekë or 30,000 (thirty thousand) euros cheaper than the initial purchase price.

"Furthermore, from the chronological analysis of the actions carried out on this property, it results that the citizen Enxhi Shima, has concluded a Sales Contract, with no. Rep: 644 and no. kol: 245, dated 15.05.2019, with the seller: Enxhi Shima and the buyer: Gjenovefa Ilia Karçanaj, with the object of selling the immovable property of the type "Apartment", with property no. 6/10+5-45, cadastral zone 8380, with surface area 73.5 m2, with address "Kavajës" street, h.5, k.4, ap 45, Tirana, in the amount of 5,000,000 (five million) lek.

In conclusion, it is analyzed that the same apartment which was purchased by citizen Rafael Bistri for the amount of 78,380 (seventy-eight thousand three hundred and eighty) euros in March 2017 (with funds received from Erisa Malenllari and Andis Papa), was sold to the mother of citizen Mirlinda Karçanaj (Gjinovefa Karçanaj), in May 2019, for the value of 5,000,000 (five million) lek, i.e. about 3,000,000 (three million) lek or 30,000 (thirty thousand) euros cheaper than the initial purchase price," the file states.

Further in the file it is noted that, upon questioning by citizen Rafael Bistri regarding the circumstances of the purchase of this real estate and its sale to citizen Daniel Shima's sister (citizen Enxhi Shima), he stated in a concise manner that he was completely unaware and did not remember any circumstances regarding how this contract was signed, for what value it was purchased or the location of this property.

After providing documentation regarding the borrowing of 80,000 (eighty thousand) euros from citizens Erisa Malellari and Andis Papa, through two notarial statements signed on the same day as the signing of the property purchase contract, he stated that he had heard these names at the tables where he had sat with citizen Ermal Beqiri and that he could have met them, but he failed to provide any explanation regarding the circumstances of borrowing these amounts from these citizens.

According to the investigations, the real value of the transaction carried out for the purchase of this apartment is around 160,000 euros and not as stated in the notarial deeds, where the value of 80,000 euros was paid in cash by the investigated Mirlinda Karçanaj with income derived from criminal activity.

Based on the above evidence, it is concluded that this property is a direct product of the criminal offense of passive corruption by investigator Mirlinda Karçanaj, as a result of her actions in her capacity as the head of the AKSHI institution./ CNA
