Denunciation/Other abuses in the Municipality of Tropoja

Other abuses have been reported in the Tropoja municipality. In a complaint received by the CNA editorial office, it is stated that an audit by the Supreme State Audit Office found economic damage measures that, according to the complainant, should have been accompanied by criminal charges.

Referring to the complaint, the verification of the technical-legal documentation made available to the audit group as well as the verification of the field works for the above facility resulted in differences regarding the volumes located with the actual field works as well as volumes calculated not in accordance with the implementation project, the revised preventive project as follows in the facilities invested by the Municipality of Tropoja:

1. In the object “Reconstruction of the road in the village of “Kasaj” according to the contract with no. 2319 protocol, dated 04.05.2023, concluded between the CA Municipality of Tropoja and the Contractor EO “Nika”.shpk. The value of the contract is 69,023,526.48 lek including VAT. Differences resulted regarding the volumes located with the actual works on the ground. In total, differences resulted with consequent economic damage to the budget of the Municipality of Tropoja in the amount of 956,587.5 lek excluding VAT.

In this tender procedure, the KSHA found violations in the evaluation of the procedure by disqualifying the operator with the lowest bid, which the KSHA calls a negative financial effect on the budget when in many other cases it has called it economic damage and has filed criminal charges.

In the Procurement procedure "Reconstruction of the Fshati Kasaj Road"  with a limit fund of 79,863,397 lekë excluding VAT. From the review of the documentation in the SPE it results that the disqualification of EO "Sh." is not based on complete evidence and facts but on shortcomings and minor deviations that could be requested in writing from the entity. An action that has brought a negative financial effect on the budget of the Municipality of Tropoja for 1,943,468.4 lekë excluding VAT resulting from the difference between the bid declared the winner of EO "Nika." of 57,519,605.40 lekë and the bid disqualified in a manner not supported by law of EO "Shendelli." of 55,576,137.00 lekë excluding VAT.

2. In the facility “Reconstruction of the 9-Year School Besëlidhja e Malësia ” according to the contract with no. 3888 prot., dated 26.09.2024, concluded between the CA Municipality of Tropoja and the Contractor BOE “M./S”.shpk & “Nika”shpk. The value of the contract is 66,333,240.44 lek including VAT. The implementation period of the contract is set at 9 months from the signing of the contract. The KLSH report states that there were differences related to volumes located with actual works on the ground as well as volumes calculated not in accordance with the implementation project, the revised preventive project as follows. In total, there were differences resulting in economic damage to the budget of the Municipality of Tropoja in the amount of 3,051,619 lek excluding VAT.

According to the complaint, these damages seriously affect the progress of teaching in this 9-year school, especially the part of the school gym which, after restoration, has been completely out of order, endangering the health of the students.

3.  In the object “Reconstruction, systemization and asphalting of the Bukovë-Luzhë Center road” , according to contract no. 2319 prot., dated 04.05.2023, concluded between the CA Municipality of Tropoja and the Contractor EO “Sh.”shpk. The value of the contract is 27,919,401.3 lek including VAT. Differences resulted regarding the volumes located with the actual works on the ground. In total, differences resulted with consequent economic damage to the budget of the Municipality of Tropoja in the amount of 778,512 lek excluding VAT.

4. In the object “Asphalting system of the Dardania neighborhood”,  according to the contract with no. 1215 prot., date 24.20.2023, concluded between the CA Municipality of Tropoja and the Contractor EO “Z.”shpk. The value of the contract is 32,423,422 lek including VAT. Differences resulted regarding the volumes located with the actual works on the ground. In total, differences resulted with consequent economic damage to the budget of the Municipality of Tropoja in the amount of 621,823 lek excluding VAT.

5. In the object "Purchase of furniture for the museum hall", differences resulted regarding the volumes located with the actual works on the ground. In total, differences resulted with the consequence of economic damage to the budget of the Municipality of Tropoja in the amount of 175,000 lek. /CNA
