"The health and financial consequences fall on patients"/ KLSH: FSDKSH

The State Supreme Audit Office's report on the financial and compliance audit of the Mandatory Health Insurance Fund has highlighted serious problems that directly affect the lives of patients, jeopardize medical treatments, and financially impact their lives.

CNA has been publishing parts of the over 400-page report of the Albanian Supreme Audit Office (ALSH) day after day, where serious facts have been revealed regarding the mismanagement or misuse of medicines and the treatment of patients.

In today's article, it is reported that the Mandatory Health Insurance Fund (FSDKSH) has not entered into contracts with importers for a number of medicines included in the 2024 Reimbursement List. As a result, the failure to fulfill this obligation has resulted in a shortage of medicines on the market and has created difficulties in covering patients' medical needs. 

The report also states that due to the lack of the first alternative, citizens have been forced to buy other drugs at higher prices, covering the difference in cost themselves. As a result, the lack of intervention by FSDKSH to provide the first alternative has increased the financial burden on patients and has violated the principle of equality in access to reimbursable drugs.

“Nga auditimi mbi verifikimin e disponibilitetit të barnave alternativë e parë dhe e vetme në treg gjatë vitit 2024, u konstatua se, Fondi i Sigurimit të Detyrueshëm të Kujdesit Shëndetësor (FSDKSH) nuk ka lidhur kontrata me importuesit për një sërë barnash të përfshira në Listën e Rimbursimit 2024. Mos përmbushja e këtij detyrimi ka rezultuar në mungesë të barnave në treg dhe, si rrjedhojë, ka krijuar vështirësi në mbulimin e nevojave për mjekim të pacientëve. Veprime në kundërshtim me nenin 10 dhe 29 të Ligjit nr. 10 383/2011 “Për Sigurimin e Detyrueshëm të Kujdesit Shëndetësor në Republikën e Shqipërisë”, i ndryshuar, të cilat ngarkojnë FSDKSH-në me përgjegjësinë për të siguruar aksesin e qytetarëve në barna të rimbursueshme, përmes kontraktimit të rregullt me subjektet furnizuese. - Gjithashtu, referuar dokumentacionit zyrtar të dorëzuar nga importuesit, është evidentuar se mungesa e furnizimit për disa barna është pasojë e: tërheqjes nga tregu; ndalimit të prodhimit ose mungesës së kapaciteteve prodhuese nga ana e MAT. Pavarësisht këtyre deklarimeve dhe mungesës së furnizimit për një periudhë të gjatë, barnat në fjalë janë ri-konfirmuar në Listën e Barnave të Rimbursueshme, miratuar me Vendimin e Këshillit të Ministrave nr. 491, datë 24.07.2024, me të njëjtët operatorë/importues, pa u kryer analizë risku dhe pa pasur garanci të dokumentuara për sigurimin e furnizimit të vazhdueshëm në treg. Gjithashtu, në pikën 2 të nenit “Kushti penal” të kontratës, parashikohet se: “Në rast përsëritjeje, propozohet heqja e atij bari nga Lista e Barnave të Rimbursueshme dhe kalimi te alternativa pasardhëse, me kusht që importuesi të mbulojë diferencën e çmimit ndërmjet alternativës së parë dhe asaj pasardhëse zëvendësuese”. Ky mekanizëm nuk është zbatuar gjatë gjithë vitit 2024. Moszbatimi i kësaj dispozite ka sjellë pasoja financiare për pacientët, të cilët, për shkak të mungesës së alternativës së parë, janë detyruar të blejnë barna të tjera me çmime më të larta, duke mbuluar vetë diferencën në kosto. Si rrjedhojë, mungesa e ndërhyrjes nga ana e FSDKSH për të siguruar alternativën e parë ka rritur barrën financiare mbi pacientët dhe ka cenuar parimin e barazisë në akses ndaj barnave të rimbursueshme”, thuhet në raport.

Më tej po ashtu bëhet me dije se për periudhën tetor–dhjetor 2024, nga auditimi ka rezultuar se nuk është kryer asnjë proces verifikimi i gjendjes së barnave të përfshira në Listën e Barnave të Rimbursueshme (LBR) përmes sistemit informatik “e-Depo”. Ky sistem është parashikuar si mjet monitorimi në kuadër të kontratave të lidhura me subjektet importuese. Kjo si pasojë ka rritur ndjeshëm riskun e mungesës së barnave, si në rrjetin farmaceutik të hapur, ashtu edhe në atë spitalor

“Gjithashtu, për periudhën tetor–dhjetor 2024, rezultoi se nuk është kryer asnjë proces verifikimi i gjendjes së barnave të përfshira në Listën e Barnave të Rimbursueshme (LBR) përmes sistemit informatik “e-Depo”, i cili është parashikuar si mjet monitorimi në kuadër të kontratave të lidhura me subjektet importuese. Procesi i vlerësimit të disponibilitetit të barnave është mbështetur ekskluzivisht në vetëdeklarimet e subjekteve importuese, pa u shoqëruar me asnjë veprim kontrolli apo verifikimi të brendshëm nga ana e institucionit, duke e bërë procesin jo tërësisht të besueshëm dhe të pambështetur në evidenca objektive. Veprime dhe mosveprime në kundërshtim me nenit 11, pika 1 të kontratës, duke evidentuar mangësi sistematike në funksionimin e mekanizmave të brendshëm të verifikimit dhe mbikëqyrjes. - FSDKSH nuk ka vënë në dijeni Agjencinë Kombëtare të Barnave dhe Pajisjeve Mjekësore (AKBPM) lidhur me mungesën e furnizimit të këtyre barnave në kundërshtim me përcaktimet e nenit 16, pika 1, germa “d” të Ligjit nr. 105/2014 “Për barnat dhe shërbimin farmaceutik”, i ndryshuar, Mungesa e këtij komunikimi ka penguar ndërmarrjen në kohë të masave të nevojshme rregullatore nga autoriteti përgjegjës, siç janë revokimi i autorizimit të tregtimit, pezullimi i përkohshëm apo identifikimi i alternativave të mundshme për zëvendësim, duke rritur ndjeshëm riskun e mungesës së barnave, si në rrjetin farmaceutik të hapur, ashtu edhe në atë spitalor”, evidentohet në raportin e KLSH-së.

Në raportin e auditimit, KLSH rekomandon që FSDKSH të marrë masa që në procesin e përgatitjes së listës vjetore të barnave të rimbursueshme, të kryhet një analizë e plotë e riskut për secilin ilaç, në mënyre që të mbrohet interesit publik dhe të garantohet furnizimi i qëndrueshëm me barna. Gjithashtu, sipas KLSH-së, kjo analizë e FSDKSH do të sigurojë që barra financiare për diferencën e çmimit midis alternativës së parë dhe zëvendësueses të mos bie tek pacientët.

“The Compulsory Health Insurance Fund (FSDKSH) shall take measures to, in the process of preparing the annual list of reimbursable medicines, carry out a complete risk analysis for each medicine, taking into account the importers’ documentation and ensuring a stable supply on the market, in order to avoid the re-inclusion of medicines with ongoing supply problems without verifiable guarantees, in order to increase the effectiveness of the supervisory functions of FSDKSH, ensure equal access of patients to reimbursable medicines and protect the public interest through a more responsible and sustainable management of the list of medicines. Also, in cases where repeated violations are found, the possibility of removing the medicine from the List of Reimbursable Medicines and switching to the next alternative should be considered, provided that the Importer covers the price difference from the first alternative to the next alternative, in accordance with the contractual provisions, in order to protect the public interest and guarantee the supply. sustainable with medicines, as well as ensuring that the financial burden for the price difference between the first alternative and the replacement is not transferred to patients.

FSDKSH undertakes to improve cooperation and information exchange with the National Agency for Medicines and Medical Devices (AKBPM), in order to enable the timely implementation of regulatory measures to manage shortages of medicines in the market, with the aim of guaranteeing patients' access to necessary medical treatment.

The Reimbursement Directorate, in cooperation with the Control Directorate at FSDKSH, should take measures to verify the availability of medicines every month, referring to the situation reported in the “e-Depo” system. In cases where a lack of medicines is found in contradiction with the contract concluded between the parties, as well as in the absence of a self-declaration from the relevant entity accompanied by supporting documentation justifying the lack, the measures and penalties provided for in the contractual provisions should be applied” , it is stated in the recommendations that the SAI has included in the audit report. /CNA
