An agreement signed between the National Business Center (NBC) and the Institute of Fiscal Experts (IEF) has raised concerns about the distribution of a free platform for use by businesses in the field of fiscalization and accounting.

Although presented as assistance to businesses, this initiative could disrupt free competition in the fiscalization services market, creating an economic advantage for a specific platform with institutional support.

The free provision of a technological solution by a public institution in collaboration with a non-profit professional organization can create problems in the market.

Certified private operators that offer paid solutions may lose customers, not because of performance or innovation, but because of the support provided to this platform by the Central Bank.

Several businesses have reported to CNA that during a communication with IEF and SmartFin, the latter have emphasized that the application is offered free of charge until January 2026 and it is not clear whether a fee will be applied after this date.

It is also emphasized that SmartFin is a private company like others that offer the same service and is not subordinate to the Central Bank, but simply has a memorandum of cooperation with the public institution.

Law No. 9121/2003 “On the Protection of Competition” provides that any intervention by public institutions that favors one entity over others may constitute unfair state aid. The promotion of the SmartFin platform by the Central Bank may be interpreted as institutional favoritism, without being based on equal technical or market criteria.

Given this fact, CNA has also officially requested information from the Central Bank of Albania regarding the agreement with IEF, on what legal basis it was signed and whether it could violate the free market. Our request for information was made on Friday, October 31st and as of the publication of this complaint, we have not yet received a response from the institution.

The memorandum between the Central Bank and the IEF, although intended to help businesses, raises doubts about the disruption of free competition in the fiscalization market.

Without transparency, without equal criteria and without consultation with market operators, there is a risk that a platform supported by the Central Bank will be unfairly favored over licensed private operators offering the same services./ CNA
