"The European Convention was violated"/ Strasbourg Court overturns

The Strasbourg Court has today issued decisions for three Albanian magistrates. Among them is the former Serious Crimes Prosecutor, Gentian Osmani.

The European Court of Human Rights has found violations in the vetting process against Osmani and states that the dismissal from office violated Article 8 of the European Convention on Human Rights, which guarantees the right to respect for private life.

The Strasbourg Court noted that the vetting bodies had accepted that the applicant's assets had been generated from legitimate sources and that no hidden or unjustified assets had been found.

According to the Court's decision , the problem was mainly related to the way in which savings were declared and not to the existence of illegal assets. The ECtHR considered the measure of dismissal disproportionate in relation to the aims of the vetting process.

The Strasbourg decision states that as compensation, Albania has been ordered to pay Osman 6 thousand euros for non-pecuniary damage and 5 thousand euros for legal costs.

Gentian Osmani was dismissed from the Special Appeals Panel in 2019, following the Public Commissioner's appeal against the decision of the Independent Qualification Commission. /CNA
