SPAK official notification for 8 arrest warrants for the sterilization

SPAK has released an official announcement about the issuance of eight arrest warrants related to the sterilization concession. 

In the announcement, it is announced that two people have been given the measure of "prison arrest", specifically for Klodian Rjepaj and businessman Ilir Rrapaj. While for two others, the measure "House arrest" was given, and for 4 others, the measure "Compulsion to appear before the judicial police" was given.

The decision to assign personal security measures was executed by the National Bureau of Investigation and the General Directorate of the State Police.

Investigations continue in the direction of identifying the criminal responsibility of other persons who, during this procedure, have carried out actions contrary to the law and the regular fulfillment of their duties.

On 13.01.2020, the Special Prosecutor's Office Against Corruption and Organized Crime registered criminal proceedings no. 13 of 2020, which deals with the criminal offenses of "Abuse of duty" in cooperation, provided for by article 248-25 of the Criminal Code , "Violation of the equality of participants in public tenders or auctions" carried out in cooperation, provided by article 258-25 of the Criminal Code, "Passive corruption of high state officials or local elected officials" provided by article 260 of the Criminal Code, in in relation to the procedure for awarding the concession "For integrated services for the provision of a personalized set of surgical instruments, the supply of disposable sterile medical material in surgical rooms, as well as the treatment of biological waste and the disinfection of surgical rooms", from the Ministry of Health.

After the registration of the criminal proceedings, an extremely large number of investigative actions were carried out by the judicial police in the analysis of which (up to this stage of the investigation) at the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime, with decision no. 49 act dated 23.06.2023 has decided as follows:

1. Assigning to the person under CR investigation the personal security measure "prison arrest" provided by Article 238 of the Criminal Code, as a suspect for the criminal offense "Forgery of documents" committed in cooperation with the person who has duty to release the document and "Misuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

2. Assigning to the person under investigation I.Rr, the measure of personal security "prison arrest" provided by article 238 of the Penal Code, as a suspect for the criminal offense "Fraud", with serious consequences, provided by article 143/3 of the Criminal Code.

3. Assigning to the person under MS investigation the measure of personal security "house arrest" provided by article 237 of the Penal Code, as a suspect for the criminal offense "Forgery of documents" committed in cooperation with the person who has duty to release the document and "Misuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

4. Assigning to the person under SC investigation the measure of personal security "house arrest" provided by article 237 of the Penal Code, as a suspect for the criminal offense "Forgery of documents" committed in cooperation with the person who has duty to release the document and "Misuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

5. Assignment to the person under investigation A.Gj. of the personal security measure "Compulsion to appear before the judicial police" provided by article 234 of the Penal Code, as a suspect for the criminal offense "Forgery of documents" committed in cooperation with the person who has the duty to issue the document and "Abuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

6. Assigning to the person under PM investigation the personal security measure "Compulsion to appear before the judicial police" provided by article 234 of the Penal Code, as a suspect for the criminal offenses "Forgery of documents" committed in cooperation and by the person who has the duty to issue the document and "Abuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

7. Assigning to the person under GB investigation the personal security measure "Compulsion to appear before the judicial police" provided by article 234 of the Penal Code, as a suspect for the criminal offenses "Forgery of documents" committed in cooperation and by the person who has the duty to issue the document and "Abuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

8. Assigning to the person under NA investigation the personal security measure "Compulsion to appear before the judicial police" provided by article 234 of the Criminal Code, as a suspect for the criminal offense "Forgery of documents" committed in cooperation and by the person who has the duty to issue the document and "Abuse of duty" carried out in cooperation, provided by articles 186/3 - 25 and 248 - 25 of the Criminal Code.

The decision to assign personal security measures was executed by the National Bureau of Investigation and the General Directorate of the State Police.

The investigations continue in the direction of establishing the criminal responsibility of other persons who during this procedure have committed actions in violation of the law and the regular fulfillment of the duty./
