Extension of the deadline for old construction permits and carbine certificates,

The amendments approved at the last government meeting to the Territorial Development Regulation have entered into force after publication in the Official Gazette. Among a number of interventions, a new procedure for extending the deadline for construction permits for projects that have been unfinished for more than five years stands out, as well as the provision for the issuance of a special certificate for the carbine phase.

According to the Council of Ministers No. 388, dated May 28, 2026, Article 18/1 “Extension of the deadline for works that have not been completed for more than 5 years” has been added. The provision provides that for construction permits “whose validity period has expired and works under which have started more than five years ago and have not yet been completed”, developers may apply for an extension of the deadline for the construction permit.

The regulation stipulates that requests will be reviewed by local self-government units or by the National Council for Territory and Water, depending on the project's compliance with the General Local Plan and its location.

The amendments also provide for a specific application deadline. According to point 2 of the new article 18/1, “developers or entities that have benefited from development rights may apply for an extension of the construction permit deadline … within 24 months from the entry into force of this decision.”

To benefit from the extension of the deadline, applicants must submit documentation that includes a report on the reasons for the delay, the complete architectural project, the structural engineer's statement on the stability of the facility, and payment of the fine according to the legislation in force.

The same provision stipulates that, if the entities do not apply within the stipulated deadline, "the rules for confiscation will be applied according to the provisions of decision no. 589, dated 7.9.2022".

Another approved change relates to the building permit phase. In Article 27 of the regulation, point 10 has been added, according to which "after the completion of the construction of the permit, the responsible territorial development authority issues the permit certificate."

The text specifies that this certificate is issued "only for works up to the carbine stage".

The changes are also accompanied by the reformulation of the phases of the control acts during construction. Article 27/1 now includes as a separate phase "completion of the building's carbine", in addition to the completion of the foundations, installations and facades./Monitor.al
