The demand for contract marriages is increasing/ Lawyer: Men want to protect

According to the lawyer, Alban Dura, premarital contracts are also being applied in Albania.

During a TV appearance, Dura said that it is business men who mainly seek to marry under contract, but without excluding women who also seek such a thing.

"There are some countries that, in addition to the division of the property regime, regulate the consequences if they go to divorce, but there are also sanctions that can be violated during married life, such as adultery. If you violate this principle or article of the contract, you will not benefit from property or custody of the child. We do not have such an arrangement, we have only sanctioned the division of the property regime. We have not determined the other consequences if the couple goes to divorce or to court to dissolve the marriage. If the husband has income from a business or inheritance, it is determined that the property regime does not benefit the wife after the marriage, but they can reach an agreement to benefit from 10% of the income that comes after the marriage. I get more male husbands who are entrepreneurs, but there are also women who are financially well off who ask for such a prenuptial agreement. There are cases where there may be an apartment and the highest salary and they think of adjusting the property regime so that the spouse does not benefit from this income that comes from the salary. Marriage is something sacred. In difficult moments, we must find each other, but this is legal, possible and permissible and should not be prejudiced".

Alban Dura said that divorces have undergone a significant increase in recent years, as according to him, Albanians suffer from a lack of trust with their partners. The lawyer called on the institutions to support the family.

"The family is in a big crisis of trust in their spouses and in 2023 we have had 35 thousand divorces. Some may even be fictitious due to problems with expulsions or punishments in the Schengen countries. It is a scary figure that should alert the institutions that deal with social protection and the drafting of support policies for the family"./ CNA
