The Albanian government has decided to compensate the families of the victims of the Gërdec tragedy, recorded on March 15, 2008.

The decision was taken this Wednesday by the Council of Ministers, following the fine of the Strasbourg Court.

We remind you that the Strasbourg Court has decided to force the Albanian government to pay 170,000 euros for the Gërdeci case.

12 thousand euros from the amount in question will go as compensation for Zamira and Feruzan Durdaj, regarding the death of 7-year-old Erison Durdaj and the injury of 11-year-old Roxens Durdaj.

According to Strasbourg, the Albanian state violated Article 2 for the right to life, and decided a 10 thousand euro reward for 15 other people, injured or family members of the victims.

DECISION ON THE EXECUTION OF THE DECISION OF THE EUROPEAN COURT OF HUMAN RIGHTS, DATED 7.11.2023, IN THE CASE OF "DURDAJ AND OTHERS AGAINST ALBANIA" (FOR APPLICATION NO. 63543/09 AND 3 OTHER APPLICATIONS)

In support of Article 100 of the Constitution, Article 46 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, ratified by law no. 8137, dated 31.7.1996, "On the ratification of the European Convention for the Protection of the Rights of Human and Fundamental Freedoms", articles 5 and 45, of law no. 9936, dated 26.6.2008, "On the management of the budget system in the Republic of Albania", as amended, and article 14, of law no. 97/2023 , "On the 2024 budget", amended, with the proposal of the Prime Minister, the Council of Ministers

DECIDE:

1. Execution of the decision of the European Court for Human Rights, dated 7.11.2023, for the case "Durdaj and others against Albania", for request no. 63543/09 (Durdaj), no. 46707/13 (Selami), no. 46714/13 (Durdaj and Hazizaj), no. 12720/14 (Zamira Durdaj and Feruzan Durdaj), final on 7.2.2024, according to the amounts specified in appendix 1, which is attached to this decision and is an integral part of it .

2. The values ??defined as obligation in appendix 1, attached to this decision, should be converted into lek, based on the exchange rate of the bank, where the amount is deposited, on the date of making the payment.

3. The values ??defined as obligations in appendix 1, attached to this decision, to be deposited in one of the second level banks, in the name of the applicants, according to appendix 1, attached to this decision, in the amount that the Albanian state is obliged to, according to the final decision of European Court of Human Rights, dated 7.11.2023, "Durdaj and others v. Albania", request no. 63543/09, for each request.

4. Payment of the deposited amounts, according to the provisions in point 3 of this decision, in favor of all applicants no. 63543/09 (Durdaj), no. 46707/13 (Selami), no. 46714/13 (Durdaj and Hazizaj), no. 12720/14 (Zamira Durdaj and Feruzan Durdaj), to be done by the Ministry of Finance, after submitting the necessary legal documentation for making payments from the state budget, within the 3-month period from the day when the court decision has become final.

5. In case of non-payment within the 3-month period, defined in point 4, of this decision, for the amounts defined in appendix 1, attached to this decision, simple interest equal to the marginal loan rate of the European Central Bank shall be paid, during the grace period, plus 3%.

6. The financial effects foreseen for the execution of this decision are borne by the reserve fund of the state budget for the year 2024.

7. The Ministry of Finance is charged with the implementation of this decision.

This decision enters into force immediately and is published in the "Official Gazette"./ CNA
