The high number of appeals worries the Supreme Court/Appeal for justice

The President of the Supreme Court, Sokol Sadushi, has expressed his concern about the high number of appeals, which do not pass the admissibility test, and the delays in the trial for this very reason.

"The omission of the eligibility test addresses the concern of private lawyers, the State Bar and the prosecution. Lawyers must understand that the Supreme Court is a court of law and not a court of fact. It is necessary for them to follow judicial practice, in order not to invest the Court with unnecessary cases, with unsuccessful and clearly unfounded appeals", Sadushi stated.

The Supreme Court appreciates the role of the National Chamber of Advocacy, as an independent and responsible regulatory entity to address this concern of its own, with the aim of providing the highest quality and fastest justice, as one of the guarantors/guardians for the protection of the rights of the individual, as well as the help in promoting the professionalism and ethics of the majority of its members, who contribute every day to the decision-making of this Court.

Among other things, Sadushi has stated that the National Chamber of Advocacy, other public institutions, such as the prosecution or the State Bar, should play a more active role in raising legal issues before the Supreme Court, with the aim of unifying judicial practice, thus helping not only in its sustainability, but also in reducing the backlog/stock carried over the years as well as preventing a new backlog/stock.

He has appealed to all actors of the justice system to take responsibility regarding this issue, adding that it is not only the Supreme Court's responsibility.  

Abusive or clearly unfounded appeals, the taking of punitive measures, which are also known in the legislation of democratic countries, negatively affect the functioning of the judicial system and the public's trust in justice.

This brings an unnecessary additional burden on the Supreme Court, which prolongs the decision-making process, thus harming the parties in the process.

Further, in the statement of the president Sokol Sadushi, it is stated that the Supreme Court will continue to encourage lawyers to submit their appeals in accordance with the rules and legal procedures, as well as will constantly address the non-positive behavior of the parties in the trial, regardless of who represents them.
