Two detainees allowed to attempt escape/ Tirana Prosecution takes 3 employees of

The Tirana Prosecution Office has closed the investigations and sent three employees of the "313" prison in Tirana to trial for the criminal offense of "Abuse of office".

The Prosecution's announcement states that they failed to fulfill their duty in preventing the attempt of two prisoners to escape from their cell.

Specifically, the three employees did not conduct a thorough physical search of the detainee FP, who was carrying a bag in his hand, enabling the two people who attempted to escape to circulate with prohibited items within the prison premises.

Prosecutor's Office Announcement:

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, completed the investigations and sent citizens RM, BM, and OM to trial for the criminal offense of 'Abuse of Office' provided for by Article 248 of the Criminal Code.

At the conclusion of the investigations into criminal proceedings no. 5648, of 2022, initiated after the attempted escape of two prisoners A. Ç. and FP, at the 'Jordan Misja' Penitentiary, it resulted that these citizens, in carrying out the attempted escape, also benefited from the violation of guard service rules committed by some employees of the "Jordan Misja" Penitentiary in Tirana, who were on duty at the time of the escape.

According to the referral made, on 08.08.2021, the judicial police at the ICS received notification from the information office of the "Jordan Misja" Prison in Tirana that at around 15:40 of that day, detainees A.Ç. and FP attempted to escape by descending with an improvised rope with a sheet, from the ventilation section located on the terrace of building "A" to the administration stairs and were then neutralized by police forces in the courtyard of the Prison.

In the exercise of their duties as basic role employees, the defendants RMBM and OM were found to have violated the security scheme of the "Jordan Misja" Penitentiary Institution.

These three citizens were on duty as basic role employees at the time of the escape attempt and from the investigation conducted, it is fully proven that they did not carry out the control even though it was their duty according to the law and regulations. If these employees had carried out their duty, the two persons who attempted to escape would not have been able to move around the interior of the Penitentiary Institution with prohibited items or items produced by them, to use them for escape or to exercise physical violence against the prison police officers who tried to prevent them from leaving the institution's perimeter. Something that is fully proven by the video footage of the interior of Penitentiary Institution 313.

From the video footage, it is established that citizens RM, BM and OM did not conduct a physical search of the detainee FP, who clearly seemed to be carrying a bag in his hand containing prohibited items, especially small ones, making it possible for the two people who attempted to escape to circulate with prohibited items within the premises of the Penitentiary, items which were later used by them. /CNA
