The Special Board of Appeal has given the decision for the head of the High Council of Prosecution, Alfred Balla, this Tuesday. 

KPA has accepted today the request of the Public Commissioner, deciding that Alfred Balla will not be elected judge, prosecutor for 15 years, being excluded from the justice system. 

"The judicial body finds the appeal of the Public Commissioner to be right, concluding that the decision of the KPK is not based on facts and law and as such should be changed. The judicial body with a majority of votes decides to change the decision no. 675 of the KPK as below: Termination of the re-evaluation process for Alfred Balla. The evaluation subject cannot be appointed as a judge or prosecutor at any level, member of the KLP or KLGj, senior inspector of justice or general prosecutor for a period of 15 years. ", the announcement states. 

The decision was given today by the jury composed of Ina Rama, chairperson, Albana Shtylla, relator, Natasha Mulaj, Rezarta Schuetz, Sokol Çomo, members.

In June 2023, the Independent Qualification Commission did not give a final decision for Alfred Balla, that is, with a decision that means neither dismissal nor confirmation in office because it turned out that he did not have the status of a magistrate.

For this, he filed a complaint with the KPA to the Public Commissioner. 

Balla had to undergo the re-evaluation process as he worked as a legal assistant in the Supreme Court until July 31, 2017.

Initially, he opposed the vetting by "e-mail", claiming "that such a process is not necessary for him, since he does not have the status of a magistrate as a legal assistant in the Supreme Court". Balla even filed a lawsuit in the Administrative Court saying that he was dismissed from this post.

Observers of the International Monitoring Operation strongly opposed Balla's request to stop his vetting./ CNA
