The college dismisses prosecutor Erion Pano for problems in the wealth criterion

Unlike the Commission, the Special Board of Appeal decided by a majority of votes to dismiss the prosecutor of Tirana, Erion Pano, with the argument that this subject of reassessment had not reached a reliable level in the wealth criterion.

The Special Board of Appeal, KPA announced on Monday, April 15, the decision to dismiss the prosecutor of Tirana, Erion Pano, overturning as unfounded the decision-making of the Independent Qualification Commission, KPK for the confirmation of this re-evaluation subject.

Pano was confirmed in office by the Commission on November 24, 2022, after his explanations for the negative balances for the creation of part of the financial resources that have served for the purchase of an apartment with an area of ??83 m2 + 9.8 m2 of common area, in Tirana. Likewise, the subject's objections to findings on some professional issues were considered convincing.

The Public Commissioner, Irena Nino, found the decision of the KPK to be unfounded and asked the College to dismiss the prosecutor Pano from office for incorrect and insufficient declaration of assets, as well as professional deficiencies.

Nino argued that Pano had inaccuracies in the declaration of assets and resulted in preargued negative balances. According to her, the declaration of cash savings by the subject was contradictory and incorrect. She asked that cash savings be calculated based on periodic annual statements.

The head of the panel of the College, Rezarta Schuetz, said that at the end of the examination of the petitions of the parties, it was concluded that Pano is in the conditions of insufficient declaration of assets. According to her, KPA finds the financial impossibilities found by the Public Commissioner to be right.

Schuetz said that the non-declaration of the cash balance in years, as the only legal way to consider those amounts in the financial analysis, makes the subsequent declaration to the ILDKPKI in the "veting" statement unreliable.

As a result, the College has found Nino's claim to be correct for the inability of the subject to create liquidity, for the payment of the first installment of the apartment, concluding that Pano is in the conditions of insufficient declaration of assets.

While professional problems are considered by KPA that they cannot serve as a basis for considering the subject as unsuitable in this criterion.

In conclusion, the judicial body of the KPA, with a majority of votes, decided to change the decision of the KPK for the prosecutor Erion Pano and dismissed him on the grounds that he does not reach a reliable level in the wealth criterion./ Reporter.al
