12-page request for Arben Ahmetaj/ SPAK claims on the former deputy prime

On Friday, SPAK addressed the Parliament of Albania with a 12-page request, where it requested the removal of the immunity of the former deputy prime minister and deputy of the SP, Arben Ahmetaj.

SPAK's request for the arrest of Ahmetaj was made public yesterday, while CNA has revealed the 12 pages that went to the Assembly, where the suspicions about the connections with the incinerators are listed.

The Special Prosecutor's Office accuses the former deputy prime minister of having committed the criminal offenses of "Abuse of office", in collaboration, "Passive corruption of high state officials or local elected officials", "Active corruption of high state officials or elected officials local authorities", in cooperation, "Cleaning of the products of the criminal offense or criminal activity" in cooperation.

According to SPAK, Ahmetaj, there is a connection not only in the framework of the procedure for granting the Elbasan incinerator with a concession, but also in that of Fier and Tirana.

By intervening in this process, the Prosecutor's Office claims that Ahmetaj has benefited from:

• The amount of 170,480 (one hundred and seventy thousand four hundred and eighty) euros, in 2016 and 2017, covering the true nature of the source and presenting it as a payment made to citizens Albina Mançka and Arben Ahmetaj, against a "sale "to the citizen Andi Boni ïpayment made at the end by the citizen Helidon Begaj), of 2 (two) apartments with a surface of 124.15 m2 and a surface of 148.8 m2, located in ZK 3292, in the place called Selitë, in the building built by the company " Sheron" sh.pk, this amount paid indirectly by citizens Klodian Zoto and Mirel Mërtiri through citizens Andi Boni and Helidon Begaj;

• Land property + building with property no. 1/110 vol 12 page 26 ZK 1925 with land size 521.13 m2 and building size 98 m2 located in NB Hamallaj, identified as Vila Saphire no. 22, benefited in 2017, by the citizens Klodian Zoto and Mirel Mërtiri, indirectly, through transactions of the transfer of this property first in the name of the citizen Klodian Zoto, then in the name of the citizen Gerian Kuka and then owned of citizen Erjola Hoxha, co-habitant of the person under investigation Arben Ahmetaj.

• The amount of up to 130,000 (one hundred and thirty thousand) euros, in 2017 and 2018, covering the true nature of the source and presenting it as a payment made to the citizens Albina Mançka and Arben Ahmetaj, against a "sale" to the citizen Besmir Prifti, 1 (one) apartment with an area of ??178.68 m2 and 1 (one) garage, with a floor area of ??21 m2, located in ZK 3292, in the place called Selitë, in the building built by the company "Sheron" sh.pk, this value indirectly paid by the citizens Klodian Zoto and Mirel Mërtiri, and the commercial entity "Integrated Technology Services" sh.pk through the citizen Besmir Prifti;

• The amount is expected to be 140,000 (one hundred and forty thousand) euros, in 2018, covering the true nature of the source and presenting it as a payment made to citizens Albina Mançka and Arben Ahmetaj, against a "sale" to citizen Sonila Goxhaj, of 1 (one) apartment with an area of ??178.68 m2 and 1 (one) garage, with an area of ??21 m2, located in ZK 3292, in the place called Selitë, in the building built by the company "Sheron" sh.pk, this value paid in indirectly by citizens Klodian Zoto and Mirel Mërtiri, through citizens Sonila Goxhaj, Sokol Meqemeja and the company "Frigo Food" sh.pk

• The amount of about 34,422 (thirty-four thousand, four hundred and twenty-two) euros, received in the form of expenses for hotel or travel payments, during the period 2013 - 2017, these payments, made directly by citizens Klodian Zoto and Mirel Martyrdom, for the citizen Arben Ahmetaj or his relatives.
• The total amount of 2,007,373 (two million seven thousand three hundred and seventy-three) lek, in 2019 and 2020, in the form of payments made to various commercial entities, by citizens Klodian Zoto and Mirel Mërtiri, through to the company "Integrated Technology Services" sh.pk, in function of an investment made in the property of the apartment type with no. 7/434+1 -1 sip 167 m2, miga Reshit Collaku, apartment 1. owned by citizen Arben Ahmetaj;

As above, it is estimated that they are irregular benefits, given to the person under investigation Arben Ahmetaj, directly or indirectly, with the purpose of performing or not performing actions related to his duty and function, this behavior of the person under investigation that has enabled citizens Klodian Zoto and Mirel Mërtiri and commercial entities registered in their name or their relatives or controlled by them, to enter into contracts, in the framework of the concession procedures initiated by the Contracting Authority, Ministry of Environment, specifically:

• Concession procedure: with the object "Construction and administration of the urban waste treatment plant of the District of Elbasan for the production of energy", for which a contract was concluded between the Ministry of Environment and the company "Alblek Energy" sh.pk, with no. 11026/7 prot. date 16.12.2014,

• Concession procedure: with the object "For the construction and administration of the urban waste treatment plant of the Fier District and the production of energy", for which a contract was concluded between the Ministry of the Environment and the company "Integrated Technology Wasle Treatment Fier" sh.pk no. . 5553/5 dated 24.10.2016;

• Concession procedure: with object "For construction of landfill, incinerator and rehabilitation of existing landfills in Tirana and production of electricity Tirana Waste Treatment Area (ZTMT)" for which a contract was concluded between the Ministry of Environment and the company "Integrated Energy BY SPV s.pk with no. 6021 rap no. 2895 col dated 31.08.2017.

SPAK claims that Arben Ahmetaj has approved transfers of funds for investments in the incinerators of Elbasan and Fier. He also approved the continuation of the procedures and allowed time for the incinerators to review the irregularities.

"In conclusion, bearing in mind that all three of these procedures have resulted in significant problems that have brought damage to the state budget, where already for the first two, Elbasan and Fier, we also have court decisions to send the case for trial, both in relation to legal violations that occurred in the procedures followed and in relation to unfinished works, with fictitious payments, it is established that from the birth of these procedures until their conclusion and as long as payments were made at the time that the citizen Arben Ahunetaj has exercised the duties of the Minister of Finance, they show more clearly that the role of the person under investigation, Arben Ahmetaj, has been such that, unless he has become an obstacle, there is a reasonable doubt based on evidence, that he has been rewarded for every approval given by him", the letter says.

Thus, the Special Prosecutor's Office raises claims that Ahmetaj has favored Mirel Mërtir and Klodian Zoto "because of their close relationship"/ CNA.al
