Accused of active corruption/ GJKKO commutes sentence for Nikolin Nika

The GJKKO has sentenced Nikolin Nika, who is accused of active corruption of judges, prosecutors and other justice officials, to 1 year in prison. This sentence will be converted into probation for 2 years. The GJKKO decision comes after Nika accepted the "plea agreement" with SPAK.

Announcement:

1. The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject: "Approval of the plea agreement with the defendant Nikolin Nika, dated 05.05.2025, accused of committing the criminal offense of "Active corruption of a judge, prosecutor and other justice officials", provided for by Article 319 of the Criminal Code".

2. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Flojera Davidhi, Elsa Ulliri and Rudina Palloj, with decision No. 39, dated 29.05.2025, decided:

1. Approval of the plea agreement for the defendant Nikolin Nika, within the framework of criminal proceedings no. 131 of 2024, dated 05.05.2025, signed by the prosecutor of the case Elvin Gokaj, the defendant Nikolin Nika and his defense attorney av. AS

2. The guilty plea of ??the defendant Nikolin Nika, for committing the criminal offense of "Active corruption of a judge, prosecutor and other justice officials", provided for by Article 319 of the Criminal Code and his sentence to 1 (one) year of imprisonment.

3. Pursuant to Article 59 of the Criminal Code, the suspension of the execution of the prison sentence and the placement on probation of the defendant Nikolin Nika is ordered for a period of 2 (two) years, provided that the defendant does not commit another criminal offense and maintains contact with the Lezha Probation Service Directorate. The probation period begins on the day after the announcement of the decision to suspend the prison sentence.

4. Based on Article 60, point "9" of the Criminal Code, the defendant is ordered not to associate with convicted persons.

5. Procedural costs in the preliminary investigation phase in the amount of 6,000 (six thousand lek) and court costs will be paid by the defendant Nikolin Nika.

6. In reference to Article 406/f, point 1, of the Criminal Procedure Code, no appeal is allowed against the decision. /CNA
