Today, the Council of Ministers made several decisions related to the revitalization of the "Asllan Rusi" sports palace in Tirana and the implementation of projects at the Elbasan Metallurgical Plant.

The Council of Ministers has authorized the Albanian Investment Corporation to develop these projects.

AUTHORIZATION OF THE ALBANIAN INVESTMENT CORPORATION FOR THE DEVELOPMENT OF PROPERTY NO. 3/257, IN CADASTRAL ZONE 8210, FOR THE REALIZATION OF THE INVESTMENT PROJECT “RENOVATION OF THE PALACE OF HAND-HELD GAMES “ASLLAN RUSI””

In support of Article 100 of the Constitution, point 1, Article 7, of Law No. 71/2019, “On the Albanian Investment Corporation”, of Article 53, of Law No. 162/2020, “On Public Procurement”, as amended, and of letter “b”, point 1, Chapter II, of Decision No. 137, dated 6.3.2024, of the Council of Ministers, “On determining the criteria and procedure for granting state property for rent, emphyteusis, leasing, sale, use as collateral and use in other forms by the Albanian Investment Corporation”, as amended, upon the proposal of the Minister of Economy, Culture and Innovation, the Council of Ministers

DECIDED:

1. Authorization of the joint-stock company "Albanian Investment Corporation", itself or through the entity created by it, to act as a developer of the property specified in Appendix No. 1, according to this decision, for the purpose of implementing the investment project "Revitalization of the "Asllan Rusi" Hand Gaming Palace", in fulfillment of the public interest for the investment project.

2. The Albanian Investment Corporation and the institutions specified in Annex No. 2, attached to this decision, or the authorities authorized by them, are authorized to, within 30 (thirty) days from the entry into force of this decision, conclude cooperation agreements to determine the standard, methodology, terms and conditions of cooperation for the fulfillment of the public interest, as well as the fulfillment of the interest of the Corporation, as well as the entity/entities in whose ownership the new state property is registered.

3. The Albanian Investment Corporation is authorized to open a competitive procedure for the selection of the private partner, according to the rules set forth in decision no. 137, dated 6.3.2024, of the Council of Ministers, "On determining the criteria and procedure for the lease, emphyteusis, leasing, sale, use as collateral and use in other forms of state property by the Albanian Investment Corporation", as amended, for the development of property through the entrepreneurship instrument.

The National Territorial Planning Agency is authorized to assist the Albanian Investment Corporation in the same procedure by drafting terms of reference for architectural design projects, drafting qualification criteria for designers and criteria for preliminary and final evaluation of architectural design projects. The costs for the services provided for in this point are covered by the budget of the Albanian Investment Corporation.

4. The Albanian Investment Corporation is authorized to negotiate with private entities, with the aim of concluding the relevant contract for the development of the property for which it has a development authorization, in order to implement the investment project.

5. The Albanian Investment Corporation is authorized, by itself or through entities created by it, to carry out actions with the State Cadastre Agency, public institutions competent for planning and development of the territory, or with other institutions, within the framework of the implementation of the investment project, as well as to ensure the registration on behalf of the Republic of Albania/Municipality of Tirana/Sports Center, sh.a./Albanian Investment Corporation, according to the provisions of the cooperation agreement, of the new state property that will be created within the framework of the investment project.

6. In order to develop the property specified in this decision, in accordance with the relevant legal provisions for planning and development of the territory, the Albanian Investment Corporation is authorized to proceed with the demolition of the buildings, part of the property specified in Appendix No. 1, attached to this decision.

7. The Ministry of Education and Sports, the Municipality of Tirana, the National Territorial Planning Agency, the State Cadastre Agency, the Albanian National Olympic Committee, the Sports Center, JSC, and the Albanian Investment Corporation are charged with the follow-up and implementation of this decision.

AUTHORIZATION OF THE ALBANIAN INVESTMENT CORPORATION TO COORDINATE THE PROCESS OF IDENTIFICATION OF STATE PROPERTY OF INTEREST IN IMPLEMENTING INVESTMENT PROJECTS IN THE INDUSTRIAL AREA OF THE FORMER METALLURGICAL PLANT, ELBASAN MUNICIPALITY

In support of Article 100 of the Constitution and point 5, Article 5, of Law No. 71/2019, “On the Albanian Investment Corporation”, upon the proposal of the Minister of Economy, Culture and Innovation, the Council of Ministers

DECIDED:

1. The Albanian Investment Corporation, in accordance with its objectives, with the aim of identifying state property of interest for implementing investment projects in the industrial zone of the former Metallurgical Plant, Elbasan Municipality, is charged with fulfilling the tasks as follows:

a) To undertake all measures and procedural actions for the consolidation of state property in this area, as follows:

i. In cooperation with the State Cadastre Agency, coordination and coordination with state institutions and local self-government units, involved in issues of ownership or administration of these properties, for the provision and exchange of information or documentation required in relation to property rights, which is necessary for a reflection of the ownership situation, a more accurate determination of the boundaries of the area and the priority completion of the property registration process in the real estate registers;

ii. In cooperation with state-owned companies that use the assets within the metallurgical park area, determining the legal status in their accounting books;

iii. Negotiation with private entities, involved in the legal relationship of ownership for these properties, regarding the clarification and clarification of the status of the relevant part of state property in this area;

b) To draft and provide, in cooperation with the National Agency for Territorial Planning and the Agency for Territorial Development, a detailed central development plan for the area in which the state property is located. The costs for the implementation of this detailed central plan shall be covered by the budget of the Albanian Investment Corporation;

c) To draft and submit, in cooperation with the National Territorial Planning Agency, a development project for state property in this area. The costs for the implementation of this development project shall be covered by the budget of the Albanian Investment Corporation and/or private partners.

2. State institutions involved in matters of ownership or administration of properties, as provided for in subsections “i” and “ii”, letter “a”, point 1, of this decision, shall submit the requested information and documentation within 5 (five) days from the moment of administration of the request submitted in writing by the Albanian Investment Corporation.

3. The Albanian Investment Corporation shall submit a detailed report regarding the fulfillment of the tasks set out in point 1 of this decision to the ministry responsible for the economy, which, after confirming the fulfillment of the tasks, shall consider the request of the Albanian Investment Corporation, pursuant to point 1, chapter II, of decision no. 137, dated 6.3.2024, of the Council of Ministers, “On determining the criteria and procedure for the lease, emphyteusis, leasing, sale, use as collateral and use in other forms by the Albanian Investment Corporation”, as amended.

4. The Ministry of Economy, Culture and Innovation, the State Cadastre Agency, the National Territorial Planning Agency, the Territorial Development Agency and the Albanian Investment Corporation are charged with the implementation of this decision.
