Korça Court declares arrest illegal/ Kevi Muçllari's lawyer:

A hearing was held today at the Korça Court for Kevi Muçllari. At the end of the hearing, lawyer Endri Çela stated that his client had not used violence until he was pushed to these acts and that the attack on the member of the Pogradec Municipal Council was not due to duty.

" The court hearing on the validation of the arrest and security measure against citizen Kevi Muçllari has just concluded. The court decided to assess his arrest as unlawful and not to impose any security measure on him because, in the overall assessment of the entire situation, the court concluded that there is no reasonable doubt about the commission of the criminal offense of "assault in the course of duty" provided for by Article 237 of the Code of Criminal Procedure. The prosecution requested that the arrest in flagrante delicto be assessed as lawful and that the security measure of mandatory appearance be imposed.

Our position was to consider the arrest illegal because we were not in the conditions of the strike due to duty, since we did not strike but a joint push with the other person involved in the conflict. Secondly, this was not related to duty, since there was a push from the other person and then Kevi Muçllari reacted. This position convinced the court, accompanied by the film footage and reached a conclusion. Initially, Kevi was in charge and the position he held in court was saying "I am not a criminal. I held a position that I believe in, so I was helping the residents and I apologize for using an insult towards the councilors.

"Kevi did not go to use elements of violence until the moment when he was faced with a delay and reacted emotionally affected by the situation created. We will assess the situation further. The case has not been dismissed as the prosecution has the right to appeal, but until this procedural moment this is the court's position. Each of the parties can appeal, but we will not do so since what we requested was decided," the lawyer declared./ CNA
