The subpoena for the "January 21" case/ SPAK refutes Berisha

The Special Prosecution Office has denied the allegations made by the leader of the Democratic Party, Sali Berisha, regarding the summons for the "January 21" case.

SPAK reports that the first subpoena, sent on November 3 to the apartment, was returned to the Special Prosecution Office with the note that "the guards were authorized not to take any envelopes."

After this, the summons was sent on November 7 to the apartment, the DP headquarters and the Assembly. The prosecution reports that two days later, the receipt of the envelope sent to the apartment was refused.

Meanwhile, on November 12, SPAK says that the Human Resources and Treatment of Deputies Service in the Albanian Parliament has announced that the receipt of the summons has been rejected by the Democratic Party parliamentary group.

SPAK's reaction:

Hello,

In response to your request, we inform you as follows:

So far, two summonses have been sent through the Albanian postal service, on 3.11.2025 to the address of the residence (to be presented to SPAK on 7.11.2025) and on 7.11.2025, to the address of the residence, the Democratic Party and the Parliament (to be presented on 14.11.2025).

The first subpoena, sent to the apartment on 3.11.2025, was returned to the Special Prosecutor's Office, with the note:

"The guards are authorized not to take any envelopes."

Following this finding, the Special Prosecution Office continued with sending the summons to the three destinations (Housing, Democratic Party and Parliament) on 07.11.2025.

On 09.11.2025, the receipt of the envelope sent to the apartment was refused, while on 12.11.2025, the Human Resources and Treatment of Deputies Service in the Parliament of Albania announced that the receipt of the notification was refused by the political staff of the parliamentary group of the Democratic Party.

The letter also clarified that the notice of the summons was also sent to the official email address:

[email protected], dated 10.11.2025.

The Special Prosecution Office will continue to implement the legal provisions for the notification and appearance of the summoned person, according to the deadlines and obligations provided for in the legislation in force. / CNA
