The judge of the Special Court of Appeal against Corruption and Organized Crime, Florjan Kalaja, brings the book "Constitutional Dilemma III", which is divided into 15 chapters.

This book comes 5 years after the publication of the second volume and 7 years after the publication of the first volume of this copyright periodical.

The book is a publication that generally deals with judicial practice issues always placed in the perspective of constitutional law standards.

It is a summary and selection of judicial issues accumulated as professional experience during the exercise of the duties of a judge in the Durrës Court of Appeal, in the Shkodër Court of Appeal and in the Special Court of Appeal for Corruption and Organized Crime.

The book deals with issues such as the collision of judicial jurisdiction with the jurisdiction of the Constitutional Court on the review of by-law normative acts; access of all types of victims to the criminal process at all stages and levels of trial; the constitutional and legal problems of overlapping criminal sentences in organized crime formations for the same criminal fact; preclusion of appeals and recourses in civil and administrative court cases; the constitutional and legal problems of prohibiting the application of summary trial for criminal offenses committed by minors, women, associates of justice or for the attempt, when it turns out that the law on the criminal offense provides for life imprisonment in the structure of the criminal sanction; the problems of criminal procedural law in the way subject competence is regulated in the phase of preliminary investigations; access to the initial and reviewing administrative judicial jurisdiction of subjects incapable of work for the determination of disability and benefits from their social protection; constitutional and legal problems of non-examination of the civil suit in the criminal process; constitutional and legal problems of point 4 of article 420 of the Code of Criminal Procedure; constitutional and legal problems of the criminal offense of land occupation; constitutional and legal problems of predicting the immediate return of the lawsuit; the constitutional problems of non-recognition by law of the competence of special criminal courts in the phase of execution of criminal offenses or subjects for which they have subject competence according to the Constitution and the law; the problems of the law and judicial practice of changing the criminal decision of innocence in the reviewing court jurisdiction; the need and necessity of recognition as a constitutional principle of the codification of positive law and the constitutional problems of fixed sentences with life imprisonment provided by the Penal Code.

We emphasize that the book contains articles that are published for the first time but also articles that have been reworked and retouched, updating them with the latest legal, jurisprudential and doctrinal developments.
