After the approval of the law "On the control of the cultivation and processing of the cannabis plant for medical and industrial purposes", the government is preparing the legal acts for its implementation.

A joint instruction of the Ministry of Health and Social Protection, the Ministry of Agriculture and Rural Development and the Ministry of the Interior defines the criteria for the purity of the image and the professional criteria that must be met, as shareholders and administrators of operators that will apply for licensing and those to be employed by the National Cannabis Control Agency.

Instruction "On determining the procedures, deadlines, criteria and documentation necessary for verifying the purity of the image of the employees of the National Cannabis Control Agency, or of the licensed or permitted entities, as well as the ethical-professional criteria".

For the evaluation of the figure of purity, the Agency will cooperate with several institutions, including the State Police, the Financial Intelligence Agency, Courts, Prosecutor's Offices and the Institute of Forensic Medicine, which will conduct tests for the use of narcotics.

Employees in the agency must not be drug users, including cannabis, proven by analyzes conducted by the Institute of Forensic Medicine. The family certificate should not include members convicted with a final sentence by the Court in the last 5 years, as well as not found to be drug users by the State Police.

Their employment will be carried out through applications. The application will remain published for a period of 4 weeks on the Agency's official website (so far, 45 job announcements have been published on the Agency's official website).

The same criteria from the non-use of drugs, proven by analyzes carried out by the Institute of Forensic Medicine or even members of the family with no previous convictions, must also be met by the shareholders and administrators of the companies that will apply for the planting license for the purity of the image. and cannabis processing.

For owners and administrators who are foreign nationals with residence abroad, who for objective reasons find it impossible to perform the drug test, according to the instructions, the test must be performed in the resident state in an institution equivalent to the Institute of Forensic Medicine.

In order to verify the purity of the image, they must possess, in addition to the drug test results, the decriminalization forms.

Likewise, every employee of the company that applies for obtaining the license, the owner and the administrator, must meet the special ethical criterion, not have other commitments that place them in conditions of conflict of interest. As well as declare any other activities or shares if they own.

In addition to the criteria of clean image, employees of companies of licensed or permitted entities will also have to meet a number of professional criteria.

The directive, among other things in Article 12, stipulates that the company must employ at least 2 employees, one qualified in the field of pharmacy and 1 in the field of agro-engineering with work experience of no less than 3 years. One of these employees must have been employed as a technical manager.

The tracking employees must have a qualification in one of the sciences such as: electronics, informatics, mathematics, physics, chemistry/biology, agriculture, etc. While the employee responsible for security must have at least 3 years of work experience. The employee responsible for finance must have a master's degree in science.

According to the provisions of the law, the National Cannabis Control Agency has also been established. The National Cannabis Control Agency is a public budget legal entity under the minister responsible for health.

The agency's mission is the supervision, control and inspection of the cultivation and processing of the cannabis plant, and the production of its by-products for medical and industrial purposes, and the monitoring of law enforcement.

The medical cannabis plant is legalized in over 35 countries, including North Macedonia, Greece, Israel, Denmark, Canada and the Netherlands.
