The draft decision is clarified/ The anti-SPAK commission will consist of 11

The draft decision on the establishment of the Special Commission, the anti-SPAK commission, which is expected to be voted on in the Assembly, is clarified.

This anti-SPAK commission will be headed by Fatmir Xhafaj and aims to control SPAK.  

The draft decision specifies that the Special Commission will consist of 11 members, of which 6 are representatives of the parliamentary majority and 5 are representatives of the parliamentary minority.

The chairman of the committee is a representative of the parliamentary majority and the deputy chairman is a representative of the parliamentary minority.

The Special Commission will carry out its activity for 10 months, but in case of need, with a reasoned request of the commission, the Assembly can decide to extend the term of the commission's activity.

The group of experts will be organized into 3 subgroups that will be engaged in the 3 areas of the activity object of this commission. The number and composition of the group of experts is approved by the decision of the commission.

Draft decision: 

The establishment of the Special Parliamentary Committee "For the deepening of reforms for good governance, the rule of law and anti-corruption for Albania 2030 in the European Union".

The Special Commission in implementation of the resolution of the Assembly "On the deepening of reforms for good governance, the rule of law and anti-corruption for Albania 2030 in the European Union" has as its main purpose to direct and coordinate a deepening reform process, with the aim of: 1) improving and consolidating good governance practices at all levels, 2) deepening the fight against corruption and 3) further strengthening law enforcement, having as a guide the findings and recommendations of the European Union reports and the European Commission's Screening report for the chapter group first, as well as addressing the measures of the guidelines approved by the government "On the rule of law" and "Reform in public administration".

III. The purpose of the Special Committee's activity is to achieve, through a public, comprehensive and transparent process, based on the relevant parliamentary mechanisms, rules and procedures, and with the commitment and active contribution of the best domestic and international expertise:

i) An assessment / analysis of the current situation in the three areas, relying mainly on the findings and recommendations expressed in the reports of the European Union, through a comprehensive engagement with central and local government institutions, executive and independent public agencies, justice system institutions, local and international experts, other interested subjects, civil society organizations and public opinion itself;
ii) Drafting and approval of a long-term and sustainable National Action Plan for addressing the relevant challenges in these areas, recommending concrete measures for possible legal and institutional changes, which must be addressed in each area by the responsible institutions ;
The Special Committee consists of 11 members, of which 6 are representatives of the parliamentary majority and 5 are representatives of the parliamentary minority.

With the aim of maintaining the majority-minority ratio in accordance with the regulation, the effective use of the experience created since the beginning of the Reform in Justice, as well as ensuring the continuity of the work and the products of this process beyond the current legislature and throughout the scope of the negotiations with the European Union, as a rule, the commission will consist of Chairmen and Vice-chairmen of the Permanent Commissions: for Legal Affairs, Public Administration and Human Rights (2); for Economy and Finance (2); for European Affairs (2); for Education and Public Information Means (2); and the National Council of European Integration (2).

The names of its members will be determined by a decision of the Assembly. The chairman of the committee is a representative of the parliamentary majority and the deputy chairman is a representative of the parliamentary minority.

The Special Commission will develop its activity in a 10-month time frame. In case of need, with a reasoned request of the commission, the Assembly can decide to extend the deadline for exercising the commission's activity.

VII. The Special Parliamentary Committee organizes and conducts its activities based on the provisions of the Assembly Regulations for the functioning of parliamentary committees. The Commission will undertake all efforts to approve the final documents by a significant majority of deputies, considering it critical that the exercise enjoys broad support and reflects the need for consensus building that the Assembly, the Albanian people and international partners expect from the Commission Parliamentary Special and the process he will develop and oversee.

VIII. Next to the Special Commission, in order to carry out a process that is as comprehensive and transparent as possible, a working group of local and international experts will be established and will operate with representatives proposed by the institutions of justice, independent institutions and law-enforcement executive agencies, public administration, the world academic, public and non-public universities, institutes and organizations of civil society and media, as well as business organizations, etc.

The group of experts will be organized into 3 subgroups that will be engaged in the 3 areas of the activity object of this commission. The experts will be engaged in the function of the relevant topics, related to their fields of activity in the process of conducting the analysis and drafting the National Action Plan as well as the proposal of the relevant legislative and institutional measures. The number and composition of the group of experts is approved by the decision of the commission.

The Commission can also invite agencies and other well-known local and international experts in the relevant fields for consultations on specific issues.

The Special Commission to guarantee an objective process and in the best international standards and in full compliance with the recommendations of the European Union, invites the best international expertise, necessarily of our strategic allies, such as the European Union and the United States of America, by create the opportunity and their active participation through monitoring teams and technical assistance.
In the capacity of international experts, the commission can also invite representatives of the Council of Europe, the OSCE Presence, USAID, SIDA, member countries of the European Union, the United Kingdom, various specialized agencies in the relevant fields to participate, such as GRECO, OGP, etc., as well as lecturers with outstanding careers in Albania's partner countries for the fields of his work.

At the Special Commission, a permanent technical secretariat is set up and operates throughout the mandate of the commission, consisting of advisers/specialists from the Legal Service of the Assembly, public administration, lawyers from independent institutions and law enforcement agencies as well as other experienced lawyers who will be invited to contribute temporarily as part of this structure during the mandate of this commission. The technical secretariat will serve to support the Special Commission and expert groups in the performance of their tasks.
The Special Commission, for the realization of its object defined as above, in cooperation with the group of experts, will organize:
? Hearings for the purpose of consultation, working tables and public discussions related to the subjects of this commission's work with: i) Central and local government institutions according to the relevant areas of responsibility; ii) Institutions of the justice system; iii) Independent public institutions created by the Assembly; iv) Law-enforcement executive agencies, which have as their object the fight against corruption, administration of public property, economic crime, prevention of money laundering, financial audit and inspection, internal control, informality or market surveillance, registration and administration of property, etc.; v) Well-known experts in the relevant fields; v) Representatives of civil society organizations and interest groups; vi) Teachers and students; viii) Representatives of specialized organizations inside and outside the country, etc.;

? Collecting and processing the necessary information and data from various state structures in order to fulfill its object;

? Involvement in this process of public opinion and especially university youth, through thematic conversation spaces and an online portal specially created for this purpose, etc.

XII. Any other non-parliamentary party, which is not included in this committee, will be invited to participate in the open activities, as well as to offer concrete contributions to the committee and the group of experts.

XIII. The Council of Ministers can be represented in the activities of the Commission with the participation of the Minister of State and (1) Chief Negotiator, for (2) Relations with Parliament, for (3) Anticorruption and Public Administration and for (4) Local Government, who will can give their opinions on certain issues, as well as contribute through their experts.

XIV. The Bureau of the Assembly and the General Secretary of the Assembly are charged with creating working conditions, financial and logistical support of the activity of this Special Commission, the group of experts and the technical secretariat.
