"The General Prosecutor's Office proved the conviction of judge Irena

The Democratic Party Parliamentary Group has sent a letter to SPAK today regarding the investigation against Judge Irena Gjoka.

In a letter sent to SPAK, the DP parliamentary group demands an investigation without delay against Judge Gjoka, as according to them, the public interest is being violated.

Judge Gjoka is under investigation for the criminal offense of forgery of official documents.

The request comes after the announcement by the General Prosecutor's Office that Judge Gjoka has been convicted in the Greek state.

After the General Prosecutor's Office confirmed today that Special Court judge Irena Gjoka has been convicted in the Greek state and has hidden such a fact in her self-declaration forms, the Democratic Party Parliamentary Group has requested the Special Prosecutor's Office to conclude its investigation into the criminal offense of forgery of official documents without delay.

In the letter signed on behalf of the opposition, by the Chairman of the Democratic Party Parliamentary Group, Gazment Bardhi, it is stated that "through this confirmation of the responsible authorities, it results that Judge Irena Gjoka is in conditions of incompatibility with the constitutional function of a judge, within the meaning of Article 6/1 of the Constitution, Law No. 95/2016 and Law No. 96/2016, and has falsified acts, committing another crime, repeatedly, due to the failure to declare the expulsion order and the court decision of conviction. It is inexplicable how even today the Special Prosecution Office is dragging out the investigation into this case, continuing the deviation from the principle of equality before the law and allowing the continuation of the state of lawlessness in the judicial system."

The opposition MPs in the Albanian Parliament express their deep concern for the inaction of the Special Prosecutor's Office in a timely manner, which is bringing serious and irreparable consequences to the judicial system. "The violation of the principle of the "court designated by law" is a sufficient constitutional reason to violate any of her decision-making as a judge in the Special Court of First Instance against Corruption and Organized Crime. This has serious consequences for the justice system itself, for the work of the Special Prosecutor's Office itself, but it can also cause serious financial consequences for the Albanian state. This case also violates public trust in the justice system and creates uncertainty about the decision-making of the judicial system, violating the integrity of the entire system," the letter signed by Gazment Bardhi states.

In conclusion, the opposition emphasizes that "For this reason, respecting the principle of the independence of the judicial system and avoiding any interference in concrete cases in the investigation or in the work of the Special Prosecutor's Office, we, the opposition deputies in the Assembly, in accordance with the principle of separation and balance of powers, the principle of the rule of law, and our responsibility as deputies to protect the interest of the Albanian state, constitutionality and legality in the judicial system, demand that the Special Prosecutor's Office act in a timely manner, without further delay, impartially and in accordance with the principle of equality before the law, to investigate this case within a reasonable time. Any delay on your part for criminal liability or by other constitutional bodies for administrative liability, causes serious consequences for the public interest, for the justice system itself and for the financial interests of the Albanian state."
