Public procurement/DP: How foreign companies were left out of public works

The spokeswoman for Anticorruption in the Democratic Party, Genta Vangjeli, denounced from the blue office that foreign companies were left out of public works due to the long time of equivalence of professional licenses.

She requested that SPAK investigate these procedures.

Order No. 415 of dt. December 18, 2019 of the Minister of Infrastructure and Energy, FOR THE ONLINE ONLY APPLICATION OF SOME SERVICES includes the Application for the equivalence of the individual foreign license in study and design, and/or in supervision and validation.

If we look at the online application in e-Albania, it can be easily verified that the necessary time to receive the service is 35 to 38 days.

The same period of 38 days is needed for the equivalence of the professional license for subjects who have a professional license in the country of origin (not Albania) in the field of implementation in construction.

According to Open Data, from January 1, 2020 until now, 3449 procedures for civil works with a fund of 2.4 billion euros have been procured throughout the country, which had as a disqualifying condition the equivalence of the license for the implementation of construction works, while the deadline for the submission of offers was less and less than 35 days.

As well as 1541 procedures with a fund of 81 million euros were procured throughout the country for studies-designs, supervision and approval of construction works, while the deadline for the submission of offers was less than 35 days.

All Contracting Authorities who have set as a disqualifying criterion in the tender documents the equivalence of the professional license for subjects who have a professional license in the country of origin (not Albania) in the field of implementation in construction as well as the equivalence of the individual foreign license under study design, and/or in supervision and inspection, have knowingly disqualified from the competition the participation in the procurement of foreign operators in order to announce the predetermined winners in violation of the public procurement law/

article 2 points c, ç, article 3 points 1 and 2, article 21 point 1, article 87 point 4, article 102 point 2 and all these actions are accompanied by penalties according to article 132 of the law.

The contracting authorities did not consider the need to guarantee the accessibility of all categories of users, including foreign operators, did not encourage the participation of economic operators in public procurement procedures, nor competition between them.

The contracting authorities did not guarantee equal and non-discriminatory treatment even for foreign operators by not acting transparently and proportionally.

But they knowingly and maliciously avoided the enforcement of the law by artificially narrowing the competition. Competition is considered to be artificially narrowed when the procurement is prepared with the intention of unfairly favoring or harming certain economic operators as the case in point.

This is the reason that the billions of euros procured for the reconstruction process did not have the participation of foreign operators.

This is the reason that the billions of euros procured throughout the country for civil works and design studies, supervision and validation did not have the participation of foreign operators who were limited from the competition due to the term of equivalence of licenses which exceeded the deadline for submission of offers.

How should we react when corruption is consciously committed by the state and its institutions, when corruption takes the form of written law such as Albania's announcements, or tender documents drawn up by contracting authorities..

Is there any reaction from Spak about these corruption allegations...
