The First Instance of the Special Court Against Organized Crime and Corruption has deposed the Mayor of Tirana Erion Veliaj for the lawsuit that the latter filed against Sali Berisha for defamation.

The decision was made this Tuesday, while in the decision it is specified that the costs of the case are charged to the mayor Veliaj. In addition, in accordance with the procedures, the court has given the mayor 15 days to appeal this decision.

The decision was given by judge Erjon Bani, who decided to dismiss the case.

Erion Veliaj sued Berisha with the motivation of defamation in relation to the accusations that the latter made about connection with Iran, in the matter of incinerators.

" The accusing victim, Erjon Veliaj, on 02.10.2023 submitted to this Court the request for the trial of the criminal case with the object: The guilty plea of ??the accused Sali Berisha for committing the criminal offense of "Defamation", committed universally to the detriment of the victim accuser Erion Veliaj, provided by article 120/2 of the Criminal Code.

On 14.11.2023, a conciliation session was scheduled to take place in compliance with Article 338 of the Criminal Code. In this session, the accusing victim Erion Velia did not appear without reasonable cause, while the accused Sali Berisha, based on Article 351 point 1 of the Penal Code, after having received regular information about the reconciliation session with the Notarial Declaration No. 2797 Rep., and No. 986 Kol., dated 20.10.2023 requested that the hearing be held in the presence of his chosen defender with a special power of attorney.

Under these conditions, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Erjon Bani, based on articles 59, 112 and 387 of the Penal Code as well as the Unifying Decision No. 11, dated 14.10.2011 of the United Colleges of the Supreme Court, with decision No. 76, dated 14.11.2023, decided:

Dismissal of the criminal case with No. Basic Register 109, registration date 02.10.2023, with Accusing Victim: Erion Veliaj; accused: Sali Berisha for the criminal offense of "Defamation" provided by Article 120/2 of the Criminal Code.

Court costs are charged to the accusing victim, Erion Veliaj.

Against this decision, an appeal can be made to the Special Court of Appeal against Corruption and Organized Crime, within 15 (fifteen) days, starting from the day after the notification of this decision." - said in the decision./ CNA
