Draft opinion of Venice/Zhupa: Constitutional coup for Xhaçka's
Deputy Ina Zhupa

Deputy Ina Zhupa has reacted to the draft opinion of the Venice Commission, regarding the mandate of Olta Xhaçka.

Through a status on social networks, he calls the non-implementation of the decision of the Constitutional Court by the majority a disgrace.

She declares that the Venice Commission has already requested that the issue of the mandate be transferred to the Constitutional Court.

"The Venice Commission said what every person, every lawyer knows, the decisions of the Constitutional Court are implemented, otherwise there is no rule of law.

The majesty of a majority to not implement the decisions of the Constitutional Court should stop a second earlier. Olta Xhaçka's mandate should go to the Constitutional Court.

The Venice Commission states:

"Parliament cannot refer to the principle of separation of powers to refuse to respect and implement the decisions of the Constitutional Court. So there can be no political discretion to respect and implement the decisions of the Constitutional Court. In this specific case, the Constitutional Court has given two decisions and compliance with these decisions should not be conditioned by the vote or the parliamentary majority".

"When a judgment of the Constitutional Court interprets that the Constitution limits the decision-making power of the Parliament, the latter must implement the decision and vote on the case in question as determined by the Constitutional Court and not only on the possibility of sending the case to the Constitutional Court".

There is no more clearly!

The Constitutional Coup is over!", emphasizes the deputy./ CNA
