Part of the group that killed Devi Kasmi/ Aurel Hoxallari is sentenced to life

Aurel Hoxallari was sentenced to life imprisonment for the murder of Devi Kasmi.

Devi Kasmi was executed in Tirana, by two people on a motorcycle, who shot at the 41-year-old.

Notification of the decision against Aurel Hoxhallari

The guilty plea of ??the defendant Aurel (alias Altin) Hoxallari for committing the criminal offense "Murder with premeditated interest", carried out in cooperation, in the form of a structured criminal group, provided by articles 78/2, 28/4 as well as based on of article 334, point 3 of the Criminal Code, his sentence of life imprisonment.

1.1. The guilty plea of ??the defendant Aurel (alias Altin) Hoxallari for committing the criminal offense "Possessing and manufacturing weapons, explosive weapons and ammunition without permission", carried out in cooperation, in the form of a structured criminal group, provided for by articles 278, point 1, 28/4 as well as on the basis of article 334, point 1 of the Criminal Code, his sentence of 11 years of imprisonment.

1.2. The guilty plea of ??the defendant Aurel (alias Altin) Hoxallari for committing the criminal offense "Unauthorized possession and production of weapons, explosive weapons and ammunition", carried out in large quantities and in cooperation in the form of a structured criminal group, provided by articles 278, point 7, 28/4 as well as based on article 334, point 1 of the Criminal Code, his sentence of 15 years imprisonment.

1.3. The guilty plea of ??the defendant Aurel (alias Altin) Hoxallari for committing the criminal offense "Production and sale of narcotics", carried out in cooperation in the form of a structured criminal group, provided by articles 283, first paragraph, 28/4 as well as based on article 334, point 1 of the Penal Code, his sentence to 11 years of imprisonment.

1.4. The guilty plea of ??the defendant Aurel (alias Altin) Hoxallari for committing the criminal offense "Cultivation of narcotics", carried out in cooperation in the form of a structured criminal group, provided for by articles 284, first paragraph, 28/4 as well as based on Article 334, point 1 of the Criminal Code, his sentence of 9 years imprisonment.

1.5. The guilty plea of ??the defendant Aurel (alias Altin) Hoxallari for committing the criminal offense "Structured criminal group", provided by article 333/a, first paragraph of the Criminal Code and his sentence of 5 (five) years of imprisonment.

2. In application of Article 55, first paragraph of the Criminal Code, the combination of sentences and the final sentence of the defendant Aurel (alias Altin) Hoxallari with life imprisonment.

2.1. In support of Article 15, 16 point 1, letter a) of Law No. 81/2020 "On the rights and treatment of those sentenced to imprisonment and pre-trial detention", the defendant Aurel (alias Altin) Hoxallari, to serve this sentence in a High Security Institution, starting to serve the sentence from the day of execution of this decision.

3. Regarding the material evidence, the court finds that it was disposed of by decision no. 16, dated 10.09.2020 of the Court of First Instance for Corruption and Organized Crime, decision which was left in force by decision no. 03 , date 01.03.2021 of the Special Court of Appeal for Corruption and Organized Crime.

4. Procedural costs incurred during the investigation phase (according to the relevant form) are charged to the defendants jointly, together with the other co-defendants, and court costs according to the attached form, are charged to the defendant Aurel Hoxallari.

An appeal against this decision is allowed within 15 (fifteen) days, in the Special Court of Appeal for Corruption and Organized Crime, starting from the day after the announcement of this decision.

Aurel Hoxallari, part of the group that killed Devi Kasem, has been sentenced to life imprisonment.
