The ruling party Vetevendosje Movement (LVV) has officially appealed to the Constitutional Court against President Vjosa Osmani's decree to dissolve the Kosovo Assembly, as the Presidency announced that it is awaiting the decision of the country's highest court before deciding whether or not to announce the date for new elections.
The head of the LVV parliamentary group, Arbërie Nagavci, announced on Facebook on Monday that in addition to the request for an assessment of the constitutionality of the decree, they have asked the Court to temporarily suspend the president's decree until the final verdict is issued.
"It is clear that the President of the Republic has no discretionary right to intervene in the functioning of the legislative branch, much less to take actions that lead to the dissolution of the Assembly ," she wrote.
Osmani issued a decree on March 6 to dissolve the Assembly, which would lead the country towards early parliamentary elections.
The president has not yet signed the decree on the election date because she is awaiting the Constitutional Court's decision, her media advisor, Bekim Kupina, said on Monday.
"If the Constitutional Court deems it necessary to impose a temporary measure, the Presidency welcomes it, reiterating that the measure at no time prejudges the Court's final decision regarding the constitutionality of the decree ," he said.
Osmani justified her decree, saying that March 5 was the deadline for electing a new president of Kosovo – as her mandate ends on April 4 – but that MPs failed to meet the legal deadlines.
Nagavci argued that the president's role in this process "is strictly conditional and is activated only in circumstances clearly defined by the Constitution of the Republic of Kosovo."
Further, Nagavci added that " attempts to exercise powers that are not clearly defined by the Constitution not only harm the constitutional order, but also endanger the very democratic functioning of institutions."
Earlier on Monday, the Speaker of the Assembly, Albulena Haxhiu, said that the legislative body cannot continue its work until the Constitutional Court issues a decision.
The ruling party believes that Osmani's decree is baseless, as it launched the procedures for electing the president on March 5 and has a 60-day deadline to finalize the process. Osmani, on the other hand, insists that the 60-day deadline should have been used before March 5, and she immediately held a meeting of political parties to discuss the date of the snap election.
The meeting was attended by leaders of the opposition parties, the Democratic Party of Kosovo, the Democratic League of Kosovo and the Alliance for the Future of Kosovo, but not by Prime Minister Albin Kurti's party. In the session on March 5, the Vetëvendosje Movement presented two candidates for president: Glauk Konjufca and Fatmire Kollçaku-Mullhaxha. The session was adjourned due to lack of quorum, after being abandoned by the opposition parties.
Some lawyers have interpreted that the Assembly will have to elect the president within 60 days of the start of the session to elect the president.
Former Constitutional Court President Enver Hasani told Radio Free Europe on March 6 that Osmani's decree was "unconstitutional." According to him, Osmani had no right to dissolve the Assembly and that MPs have 60 days from March 5 to elect a president.
The President of Kosovo is elected with two-thirds of the votes in the first two rounds or with 61 votes in the third round, but 80 deputies are needed in the hall for the session to be held. For the opposition parties, the two figures presented by the LVV have been unacceptable and they have insisted on a political agreement or the presentation of a consensual figure.
The parties have held several rounds of talks in recent weeks, but have not reached an agreement. Osmani herself has aimed for a second term, but no one has proposed her name. For the LVV, she did not have the necessary votes, while for other parties, she did not personify the necessary unity that the figure of the president needs. /REL
