Hashim Thaçi's defense lawyer, Gregory Kehoe, in his opening statement said his client had no motive to commit the crimes he is accused of.

"He knew that the success of the KLA depended on international support, especially from the US," he said, citing several conditions the US had placed on the KLA for its operation, which included not they attacked civilians.

Kehoe objected to the opening statement of the special prosecutors that was given on Monday.

According to him, they missed the context of the war when the crimes are alleged to have been committed.

"The SPS wants you to believe that it had a functional command structure with effective control. This is far from the truth. We want to put the facts of what happened on the ground into context," he said.

Kehoe said that Thaçi has admitted that crimes were committed during the war by some individuals, but rejects the prosecution's accusations that these crimes were committed on the basis of a policy led by the KLA.

"He disputes the claim of the ZPS that they were committed on the basis of a policy of the General Staff or that there were systematic and widespread crimes."
