Osmani withdrew the request from the Serbian judge/ Constitutional Court: Llaban

The Constitutional Court of Kosovo issued a statement this Wednesday, following the positions expressed yesterday by President Vjosa Osmani, after announcing the withdrawal of the request on the constitution due to Serbian judge Radomir Llaban.

The Court states that Laban has been employed at the Constitutional Court since 2011, in the position of Legal Advisor, and since August 9, 2018, he has been exercising the function of Judge of the Constitutional Court, after having undergone all constitutional and legal procedures, for his proposal by the Assembly of the Republic of Kosovo and decree by the President of the Republic of Kosovo.

"In response to the interest of the media and the general public regarding the request of the President of the Republic of Kosovo dated August 5, 2025 for the withdrawal of the request KO215/25, submitted to the Constitutional Court of the Republic of Kosovo on July 22, 2025, the Constitutional Court clarifies as follows:

Based on Article 113 [Jurisdiction and Authorized Parties] of the Constitution of the Republic of Kosovo, the Constitutional Court shall deal with all cases legally submitted by authorized parties. The allocation of cases for review to the reporting judges and review panels of the Constitutional Court shall be based on clear procedural rules, which this Court strictly respects. The Constitutional Court, as a collegial body, shall take its decisions in its full composition. In this context, it is the right of the parties before the Court to request the withdrawal of the submitted requests, which the Constitutional Court shall deal with based on the Constitution, the Law on the Constitutional Court and its Rules of Procedure.

Regarding the issues raised regarding Constitutional Court Judge Radomir Laban, as you are informed, he has been employed at the Constitutional Court since 2011, in the position of Legal Advisor, and since August 9, 2018, he has been exercising the function of Judge of the Constitutional Court, after having undergone all constitutional and legal procedures, for his proposal by the Assembly of the Republic of Kosovo and decreed by the President of the Republic of Kosovo. On the other hand, the procedures for the dismissal of judges are clearly defined in the Constitution.

"The Constitutional Court, as the final authority in the Republic of Kosovo for the interpretation of the Constitution, in accordance with its responsibilities and mandate, handles all requests submitted by authorized parties with impartiality, dedication and professionalism, as defined in the Constitution of the Republic of Kosovo," the statement reads./CNA
