Regulatory payments, ERE: 374 licensees are due for 2024

The Energy Regulatory Authority (ERE) announced that there are 374 entities licensed by it that have the obligation of regulatory payments.

These payments are money that each entity pays on behalf of the Entity as an obligation for the license it holds in the market where it operates and must be made every year, taking into account the annual turnover that each of them has.

Earlier, ERE during April asked the entities to submit financial statements, which should be clean from other activities where the entities may be involved in order to avoid cross-subsidies.

ERE has also determined the obligations of the entities that had no activity during 2023, thus making it impossible to give an accurate turnover.

"For licensees who have not developed an activity or who, at the time of calculating the regulatory payment, have not started the activity for which they were licensed, pursuant to provisions 5.2 and 6.3 of the amended "Regulation on the determination of regulatory payments", the regulatory payment it is calculated in the fixed amount of 100 thousand lek" estimates the Entity.

According to the decision, the same fixed amount has been applied to companies that have more than one license and have not presented the financial statements separated according to the licensed activities in implementation of the request for the separation of accounts defined in article 35, point 1 of law no. . 43/2015 "On the electricity sector" as amended, and point 3 of article 30 of law no. 102/2015 "On the natural gas sector" as amended.

"Thus, in cases where companies submit consolidated accounts, then among two or more licensed activities, only one of them has been calculated the regulatory payment through the specific share of income to the total income of the sector, while for the activities of in others, the fixed fee of 100,000 ALL is automatically applied", the document states.

The entity has clarified that the differences resulting from the certified financial statements of 2023 will be considered in the calculation of the adjustment payments of the following period.

Regulatory fees must be paid no later than 30 days from the publication of the decision in the Official Gazette.

"The licensees subject to this decision (according to the attached table) must make the regulatory payments to ERE, no later than 30 days from the publication in the Official Gazette of this decision, otherwise, they will be subject to the application of the provided administrative measures in article 42, point 1, letter ç), point 2, letter b) and article 107, of law no. 43/2015 "On the electricity sector" amended, article 27, point 1, letter "ç" and article 106, letter "a" (xi) of Law no. 102/2015 "On the natural gas sector", amended and Article 5, point 1, of the "Regulation on procedures for imposing and reducing fines" approved by decision no. 125, dated 29.07.2016, of the board of ERE", underlines the decision of ERE./Monitor
