In 1996, a store with a surface area of ??31 m2 was built with permission on Bogdanev street in Tirana by the Heta family on their land and 2/6 of this property belongs to Filda Heta.

"Neighbor Eduard Kelmendi offered us a builder, a firm G2 with legal representative Gëzim Papinova, to give the store that a building would be built next to the courtyard of the Avni Rustemi school. And he didn't give a correct answer and from 2014 to 2018, this remained as a hostage from the contract we signed", says whistleblower Filda Heta.

Eduard Kelmenti used the mandates that Heta members signed when they received 30,000 Euros, and began to pressure the 3 brothers and Filda Heta to return the 30,000 Euros or give him the shop. The pressure worked for the three brothers, who gave their share to Eduard Kelmendi with a notarial declaration, drawn up in violation by the notary Rezarta Koçi.

"Meanwhile, he started pressuring me and my brothers to return the money. I used to go out on the street, I come to work, I ask you to return my money. Eduardi, by means of pressure, asking the brothers for the money, reached the notary Rezarta Koçi to do these actions. The brothers have passed a part of this property to Eduard. By law, co-ownership requires all co-owners to agree and sign for legal action. I didn't agree on this," Mrs. Heta continues the denunciation.

On the same day, the same notary Rezarta Koçi, revoked the agreement made with the Heta family for the purchase of the store to the G2 firm, again in violation of the law, acts for which the notary Rezarta Koçi is serving a prison sentence.

"Thanks to the actions taken at the notary Rezarta Koçi, Eduard Kelmendi becomes a co-owner in this building with me. Eduard Kelmendi is suing me for property distribution. In the first stage of the division, he wins, I appeal and the Court of Appeal overturns this decision. This decision was made without all co-owners. It is not legal, send it back for reconsideration and call the G2 firm. Who is this Edward? The Court of Appeal points out what position it had in this contract. A trial is held again for reconsideration in the Court of First Instance, Eduard Kelmendi does not appear again and that case is dismissed", says the whistleblower.

He admits that Filda Heta did not sign the contract for the transfer of ownership of the store and that the store was taken illegally.

I had to build that building, this one took it after me, because one of the owners announced it and it got mixed up, not this one signed, no this one didn't sign and this job got mixed up. I'm on trial with that too. They signed 4, while only this girl, Filda Heta, did not sign, because she did not want to sign with this, without a security document.

After taking over the store, Eduard Kelmendi appealed to the court for the apportionment of the store, but the Court of Appeal overruled him with the argument that the ownership was transferred irregularly./tvklan.al
