He worked for 14 years in the mine, Hajredini gets a "ridiculous"

Hajredin Cera tells the investigative show "Stop" on TV Klan that he worked as a miner in the Valias mine and after he got very sick, he was treated with KEMP in the amount of 110 thousand old Lek, being calculated with minimum wage.

Complainant: I am Hajredin Cera. I worked from July 1982 until November 30, 1996 at the Valias mine. Meanwhile, during these years, I have obtained the maximum qualification of a miner. After the mine was closed in 1996, the mine burned completely and became unusable, all the documents there were burned. In 2000, the government issued a decision to give all miners who are 40 years old the special miner's treatment.

Journalist: How much was your salary?

Complainant: I had 80 thousand Lek at that time. I worked in the mine for 14 years and 6 months without interruption. In 2009, I became seriously ill in my liver and almost died. It was not known whether I would return or not.

Journalist: When you left the hospital, you continued the procedures for the KEMP benefit...

Complainant: Yes, I got it. When I go to get the money I had, I had 110 thousand Lek. With the salaries I received, my salary did not go anywhere. At the end of the KEMP, the government's decision came out that I was reduced to 5 years and I won the pension.

Journalist: Since the age of 55?

Complainant: Yes. At the age of 60, I retired fully.

Journalist: What was the value of the pension?

Complainant: 140 thousand Lek. I filed the complaint in court. My pension was supposed to be 200,000 basic Leksh, plus additional.

Hajredini appealed to the court and during this time he retired. The court decided that the calculation of KEMP should be done with a salary based on the job position, and Hajredini received the differences. But the pension was again assigned on the basis of the minimum wage, since the documents had been burned. Hajredini now requests the calculation of the pension after the court decided the calculation of the disability pension, but not the old age pension.

Complainant: The court decided to take me to the country, but now it was done. I had applied for disability, but the pension also came out. I had been receiving my pension for 2-3 months. The court gave me the decision. He gave me the right.

Journalist: The defendant, the Tirana Regional Directorate of Social Insurance, was forced to recalculate the disability benefit according to the provisions and formula of Law 7703/1993, article 59 and 60. Has the pension been recalculated?

Complainant: No, I continue to receive my pension like that.

Journalist: In the meantime, the pension differences that you received before, he benefited, he received?

Complainant: While I received the calculation of the disability that was due to me, they did not calculate my pension continuously and the pension remains where it is.

The Social Security Institute replies that the calculation, if there are no documents, is based on the minimum wage. Hajredini now only has to turn to the Court again to decide on the old age pension as he did with the disability pension./tvklan.al
