Investigations into this case started after a report made in August by the elected mayor of Himara, Fredi Beleri, who was convicted a few weeks ago by the Special Court on charges of electoral corruption. The elected mayor of Himara claimed a series of falsifications on the denounced surface, from the fact that it did not belong to the Mëhilli family, to its registration as land, while it was part of the agricultural fund. According to Mr. Beleri, "the cadastral number of the parcel determined in AMTP, for the area of ??5512 m2, specifically with no. 36/36/1, do not match any of the cadastral numbers of the cadastral map, on the basis of which the division of agricultural land was made and that reflects the plots and the agricultural land fund of the cooperative of the village of Gjilek-Dhermi in time, a map that Himarë Municipality possesses .

According to the announcement of the Special Prosecutor's Office, Mr. Goro " in two different episodes committed actions contrary to the law. In cooperation with the Director of the Municipality, Bashi, without making any concrete verification according to legal obligations, have forwarded to the competent bodies completely falsified documents, making possible the registration of an area of ??5512 m2 of agricultural land owned by the state, in favor of the subject. private. This area of ??land located in Dhërmi, Vlora, after being registered in the public registers thanks to the illegal actions of the responsible persons (the two officials of the Cadastre of Vlora) has been alienated in favor of a private entity, stripping the state of its ownership .

According to the Special Prosecutor's Office, " this alienation was accompanied by unfair material benefit for the other citizen under investigation, Stavri Mëhilli ". The latter, according to the Special Prosecutor's Office, " has used forged documents and forms more than once, in the presence of several institutions but also in the procedural bodies, actions which have subsequently led to the initial registration in the name of Foto Mëhil (the heir) of an area of ??agricultural land of 5512 m2, located in Dhërmi, Vlora. After the registration of the property in the name of the heirs, including the citizens under investigation, it was continued with the transactions which concluded in the registration of the property in the name of the private company represented by the citizen Artan Gaçi .

Mr. Gaçi is also one of the names mentioned by Mr. Beleri, according to whom the whole practice was aimed at transferring the area of ??the land to the husband of the former minister, including it as part of the area where he started to build a tourist complex. In October last year, the Special Prosecutor's Office announced that this area was placed under seizure by the Special Court. Ms. Xhaçka reacted at that time, stating that it was a measure taken "to investigate the origin of a private property since 1994". Mr. Gaçi as well as Mr. Goro were interrogated by the Special Prosecutor's Office.

But it seems that the problems are not only with this part of the land where Mr. Gaçi has invested, but also on the rest of the surface, where also, through falsifications, Mr. Goro has alienated a land owned by the state. " In the capacity of the Mayor of Himarë, in another episode subject to the investigation of the same criminal proceeding, Mr. Goro committed actions contrary to the law. In cooperation with Director Bashi, he has carried out with concrete actions the actual displacement on the ground of an area of ??agricultural land of 5080 m2, superimposing it on another property owned by the state. The citizen under investigation has exceeded all powers that the law recognizes, stating the existence of an overlap of immovable assets on the ground and then confirming a placement plan, which turns out to have served not only for subsequent transactions between the subjects of different but also for the development of the property, including here the equipment with a construction permit for a tourist complex in the name of a commercial company, which will be built on both surfaces in question which are bordering (10,592 m2)" , explained in the announcement of Special Prosecutor's Office.

The construction of the tourist complex by Mr. Gaçi had earlier been the subject of political debates in the parliament. The former minister's husband had obtained the status of a strategic investor. This fact, according to the opposition, constituted a conflict of interest, and for this reason it demanded the termination of the mandate of the deputy, for Mrs. Xhaçka. The socialist majority did not accept the request. The case ended up in the Constitutional Court, which considered the parliament's decision to be wrong and ordered that the case be presented to it for consideration.
